… the Contractor will be obliged to develop and agree on a Project for the temporary organization of traffic. 5.4. The subject of the contract includes the performance of all works and activities necessary for the proper performance of the contract in question in the material scope included, in particular, in the design documentation, technical specifications for the execution and acceptance of works and in bills of quantities (measurements should be treated as an auxiliary element). 5.5. Paper version of the above-mentioned documents for inspection at the Ordering Party's registered office, ul. Rybacka 38 in Żagań from 7 a.m. to 3 p.m. 7 5.6. The quality of materials, products and components supplied for construction must be in accordance with the standard requirements, attestations, certificates of approval for use and technical design findings and the requirements contained in the OTSC. 5.7. Equivalence of materials and devices 5.7.1. Where the Contracting Authority has described the subject-matter of the contract by indicating trademarks, patents or origin, it should be understood that solutions equivalent to those described are permitted and such reference is accompanied by the words ‘or equivalent’. This provision also applies to all types of SURVEYS, TECHNICAL ASSESSMENTS, TECHNICAL SPECIFICATIONS and TECHNICAL REFERENCE SYSTEMS to which the Contracting Authority refers in the documentation of the procedure. 5.7.2. The contracting authority allows the use of equivalent building materials, which are listed in the design documentation, bills of quantities and detailed technical specifications, provided that the equivalent materials will have at least the same technical parameters or better than the materials listed in the above-mentioned documents. 5.7.3. The Contractor is obliged to demonstrate that the offered supplies (equipment and construction materials), services or construction works meet the requirements of the Ordering Party. 5.7.4. All products from specific manufacturers specify the minimum quality parameters and performance characteristics that products must meet in order to meet the requirements set by the Ordering Party and are only a quality standard of the subject of the contract. 5.7.5. By the provision concerning the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in generally available sources, catalogues, manufacturers' websites. Operating with exemplary manufacturer's names is only aimed at clarifying the level of the Ordering Party's expectations in relation to a specific solution. Thus, the use of the names of producers or products is purely illustrative. If the Ordering Party, when describing the subject of the contract, indicated the designation of a specific manufacturer (supplier) or a specific product, it also allows equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thus recognizing each product with the indicated parameters or better. In such a situation, the Ordering Party requires the submission of relevant documents that authenticate these materials or devices. 5.7.6. The Contractor shall be responsible for proving that the materials/works offered are equivalent to those specified by the Contracting Authority.
