The detailed scope of works is determined by the bill of quantities and the Project Documentation. Where trade marks, patents or origins, a source or a specific process characterising the products or services provided by a particular economic operator appear in the materials describing the subject-matter of the contract, such indication shall be understood to be accompanied by the words or an equivalent .. The Ordering Party accepts equivalent materials and/or solutions provided that the technical, quality and performance parameters are not inferior to those indicated in the documentation and do not lead to a change in technology. The names indicated in the documentation should be taken as examples. By describing the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority accepts solutions equivalent to those described. The contracting authority may not reject a tender on the sole ground that the works, supplies or services offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract refers, provided that the Contractor proves that the solutions proposed satisfy in an equivalent manner the requirements set out in the description of the subject-matter of the contract. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Contracting Authority. In this case, the Contractor shall attach to the tender a list of equivalent solutions together with its description or standards.
