… contract. 2. Type of contract: services. 3. CPV codes: 1) Main CPV code: 7730000-3 Gardening services 4. In accordance with Article 121(1) of the Public Procurement Act, the Contracting Authority reserves the obligation for the Contractor to perform in person key tasks relating to: 1) Planting and replanting of all trees described in Table 1 in the Description of the subject of the contract, constituting Annex 1 to the ToR. In the context of such a reservation and described by the Ordering Party in Chapter The following restrictions apply to the Contractor as regards the conditions of participation in the public procurement procedure: - it is not possible for the Contractor to rely on the experience of the entity making resources available, - it is not possible for the Contractor to entrust the performance of key tasks reserved for personal performance by the Contractor to a subcontractor. 5. The Contractor may entrust the performance of part of the contract (scope of the contract) to a subcontractor - those that have not been reserved by the Ordering Party in para. 4. The Ordering Party allows the subcontractor to perform the subject of the contract in the form of: 1) Purchase of planting materials and necessary equipment along with their transport, 2) Execution of edges around planted trees at ul. 3 May. 6. The contractor intending to perform the contract with the involvement of the subcontractor(s) must clearly indicate in the tender which part (scope of the contract) the subcontractor will perform on its behalf and the name of any subcontractors, if known. To this end, please fill in the relevant section of the tender form, which is attached as Annex 2 to the ToR. If the Contractor does not intend to perform the contract with subcontractors, enter ‘not applicable’ or other similar wording in the form or leave the box blank. 7. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract. 8. Reasons for the lack of division of the awarded contract into lots. According to the contracting authority, dividing the contract into lots would generate higher procurement costs, create a risk of collision in the work performed between contractors and could generate a conflict between them if the work is performed within one place at different times. This would result in the risk of incorrect performance of the contract. In the opinion of the Contracting Authority, objective and reasonable reasons militate in favour of awarding the contract to a single Contractor as a whole. The lack of division into parts will not hinder fair competition and the participation of small and medium-sized enterprises in the proceedings. The lack of division of the contract into lots is justified, both economically and logistically.
