A detailed description of the subject-matter of the contract and the manner of performance of the contract are set out in Annex 1 to this ToR and in the draft provisions of the contract constituting Annex 3 to the ToR. 4. The Municipal Board of Streets and Bridges informs that TAURON Nowe Technologie is responsible for maintaining the lighting infrastructure in the city of Chorzów. Therefore, the Contractor is obliged to contact TAURON branch in Chorzów at ul. Olszewski 1 in order to be allowed to perform works. 5. Requirements and conditions for performance of the contract: 1) During the implementation of the task, the Contractor will be obliged to ensure proper order, order, compliance with health and safety regulations, protection of facilities and networks located on the site and equipment for the development of the site and maintain them in proper technical condition, and after the completion of the site, 2) the Contractor will be obliged to protect underground and above-ground equipment as well as buildings and construction works located in the area and in the immediate vicinity of the implementation of the investment; 3) The Ordering Party requires that the waste resulting from the execution of the works is transported and stored at the waste disposal site at the contractor's expense. The Contractor will be obliged to provide the Ordering Party with relevant documents 4) Throughout the entire period of the contract, the Contractor is responsible for the construction site transferred, securing the place where the works are carried out, maintaining temporary markings, cleanliness on roadways and pavements both in the area of the works carried out as well as access roads. The contracting authority shall allow equivalent tenders to be submitted: 1) The Contracting Authority informs that whenever the origin (brand, trademark, manufacturer, supplier) of materials is indicated in this tender specification or annexes to the tender specification, or the standards, technical assessments, technical specifications or technical reference systems referred to in Article 101(1)-(3) of the Public Procurement Law Act are indicated, the Contracting Authority allows the offering of materials or solutions ‘equivalent’ in terms of technical, performance and operational parameters, provided that they guarantee the execution of works in accordance with the building permit issued and ensure that technical parameters not inferior to those assumed in this tender specification are obtained. 2) In the case of submitting an equivalent tender, the Contractor must prove to the Ordering Party that the offered supplies (products / materials) or solutions comply with the requirements of the Ordering Party described in this Terms of Reference and / or the Annexes to the Terms of Reference.
