At the same time, the contracting authority explains that the forecast consumption of natural gas, amounting to 762 040 kWh, was estimated on the basis of the historical consumption of natural gas for a period of 48 months. … The supply of gas will be carried out on the basis of a contract, the draft of which constitutes Annex 8 to the ToR, and will be carried out in accordance with the provisions of the Energy Law Act of 10 April 1997 (consolidated text: Journal of Laws 2026, item 43, as amended), of the Civil Code (Journal of Laws 2026, item 795, as amended) and the implementing rules issued on the basis thereof. 4. The Ordering Party makes available the tariff protection statement, which is attached as Annex 9 to the ToR. 5. If, pursuant to an act of universally applicable law, the maximum price of gaseous fuels or the maximum rate of any fees related to the implementation of the Agreement applies during the term of the Agreement, including fees for the provision of gaseous fuel distribution services, then the rates of prices and fees shall apply in settlements for that period not higher than the rates of prices and maximum fees. This provision applies directly, i.e. without the need to amend the contract in the form of a written annex.
