… the offered subject-matter of the contract must meet. 2. The contract in question is co-financed under the ‘Cyber-safe water supply’ project implemented under measure C3.1.1. Cybersecurity – CyberPL, funded by the National Recovery and Resilience Plan. The grant competition entitled: “Cybersafe Waterworks” number KPOD.05.10-CW.01-001/25. 3. The Contractor undertakes to supply brand new, unused equipment free from physical and legal defects and to issue documentation concerning the delivered subject of the contract, e.g. certificates, attestations, declarations of conformity, instructions for use, etc. 4. The Contractor is obliged to perform the subject of the contract in accordance with the rules and guidelines of the Ordering Party, the provisions of the OPZ and the draft contract. 5. The Contractor must supply all the equipment and components necessary for the proper functioning of the whole at his own expense. In the event that during the execution of the subject of the contract it turns out that any device, element and / or license is missing, the lack of which will result in the malfunction of the entire subject of the contract, the Contractor will provide them at his own expense. 6. The Contracting Authority shall allow the Contractor to apply solutions equivalent to those indicated by the Contracting Authority. By offering a solution equivalent to the one described above, the Contractor is obliged to demonstrate (prove) equivalence in terms of the indicated parameters, which must be at a level not worse than the parameters indicated by the Contracting Authority - the Contractor must demonstrate (prove) that the proposed solution meets in an equivalent manner the requirements set out in the ToR and its annexes, in particular as regards parameters. 7. If the description of the subject-matter of the contract contains any reference to a specific product, source, trademarks, patents or origin or to a specific process which characterises the products or services provided by a specific Contractor, it should be assumed that the Contracting Authority has provided such a description indicating the type and allows for the submission of equivalent tenders, in particular with technical, performance, functional and quality parameters not inferior to those given in the description of the subject-matter of the contract. 8. At each request of the Ordering Party, including before the use of materials and equipment intended for use in the performance of this contract, the Contractor shall provide the Ordering Party with documents confirming their release for free circulation. 9. If the Contractor does not indicate an equivalent solution in the tender, the Contracting Authority will consider that the Contractor will implement the subject of the contract in accordance with the solutions indicated in the tender specification and its annexes. 10. The guarantee for the delivered subject of the order is a minimum of 12 months. In the case of a longer warranty offered by the manufacturer, the manufacturer's warranty will apply.
