The Contractor's offer, which will offer a warranty period of less than 24 months, will be rejected as incompatible with the FTZ. 5. If the Contractor does not offer any guarantee period in the Tender Form (i.e. leaves an unfilled declaration on the guarantee period offered for the entire subject of the contract), he will receive 0 (zero) points in the ‘Guarantee period’ criterion and the Contracting Authority will consider that the Contractor offers a 24-month guarantee for the entire subject of the contract starting from the date of signing the delivery and acceptance protocol for the subject of the contract without reservations, confirming the proper performance and receipt of the subject of the contract. 6. The Contractor will be obliged to perform the contract, in accordance with the applicable law, the requirements of the Ordering Party contained in the procurement documents and in accordance with the submitted offer, in particular with: due diligence, safety, good quality, proper organization and the provisions of the concluded contract. 7. The subject of the order must be accompanied by a user manual in Polish. 8. If the Customer indicates in the description of the subject of the contract trademarks, patents or origins, sources or a specific process that characterizes the products or services provided by a particular Contractor, it is allowed to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters, etc. 9. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor shall attach to the tender a list of equivalent solutions, together with its description or standards. 10. Where reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2) and paragraph. 3 and 5 of the Public Procurement Act, the Employer allows solutions equivalent to those described. 11. The Contractor shall indicate in the tender the parts of the contract which he intends to subcontract or the names of the subcontractors. 13. The rules concerning the employment and settlement of subcontractors are contained in the Contract Model constituting Annex No. 3 to the Terms and Conditions of the Order. 14. The contracting authority does not allow the submission of partial tenders. 15. The Employer does not provide for the requirement of employment on the basis of Article 95 of the Public Procurement Act.
