Warranty and guarantee: The contractor must provide a guarantee for a minimum period of 36 months for the subject of the contract, excluding the systems and equipment covered by the subject-matter of the contract for which the manufacturer provides a guarantee. In the case of systems and equipment covered by the subject-matter of the contract, the warranty period applies in accordance with the manufacturer's warranty terms, but not less than 36 months. The contractor is obliged to give a minimum of 5 years warranty on the subject of the contract. Detailed terms and conditions of the guarantee and warranty are set out in the draft contract, which is an integral part of the Terms and Conditions of the Contract. 2. The subject of the contract should be performed in accordance with the attached documentation including functional and utility programs for two stages, description of the subject of the contract, design of a video monitoring system on the MS campus and technical knowledge, construction art, construction law and other applicable regulations, including in particular compliance with the principles of ensuring accessibility in accordance with the requirements of the Act of 19 July 2019 on ensuring accessibility for people with special needs, other provisions related to the subject of the contract. The attached documentation shall be subject to mandatory verification by the Contractor. This does not exclude the obligation to carry out demolition and associated works, without which the subject-matter of the contract could not be ready for operation without reducing the value in use. 3. The documentation may be used by the Contractor only for the preparation of the tender and the correct valuation of the contract. It cannot be used for any other purpose. 4. The Contractor is obliged to familiarize himself with the documentation, check its completeness and verify it, familiarize himself with the conditions of implementation and include them in the valuation and the date of performance of the subject of the contract. 5. Any doubts should be clarified by the Contractor with the contracting authority at the stage of preparing the tender, in accordance with the procedure set out in these specifications. 6. The price specified in the tender for the performance of the subject of the contract is a flat-rate price not subject to verification, as a result of which the need to perform additional works, without which the subject of the contract could not be carried out, and which the Contractor did not predict beforehand will not have an impact on the amount of remuneration - it will not constitute a basis for increasing the price specified in the tender with the reservation described in the draft contract attached to the FTZ.
