… of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the PPL Act, the contracting authority allows solutions equivalent to those described. 3. The contractor who relies on equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the contracting authority. In this case, the contractor shall attach to the tender documents confirming the equivalence of the solutions offered. The burden of proving equivalence lies with the economic operator. The Contractor shall demonstrate equivalence by any (reliable) means. Failure to demonstrate equivalence results in the rejection of the tender as non-compliant with the terms of the contract. 4. Where trade marks, patents, the manufacturer or the specific origin of the product are indicated in the procurement documents, these headings must be presumed to contain the words ‘or equivalent’. The procurer shall require that the supply offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, whether as main components or as components, as part of the service delivery environment or as an accompanying solution, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of state security; (2) an ICT product, the type of which has been specified in the decision on the recognition of the provider as a high-risk provider referred to in Article 67b(2) of Regulation (EC) No 44/2001; 15 of that law, nor the ICT services or ICT process specified in that decision. Failure to comply with the above requirement results in the rejection of the tender pursuant to Article 226(1)(17) or (19) of the Public Procurement Act, respectively.
