Wherever a type or manufacturer of materials or equipment is named in the FTZ and its annexes, the Contracting Authority shall allow equivalent solutions. 4. The conditions for the performance of the contract and the guarantees include the dimensions of the works, specifying the type, method of execution and quantity of the works to be carried out – constituting Chapter V of the FTZ and the provisions of the contract constituting Chapter III of the FTZ. 5. The activities referred to in § 1 sec. 1 of the provisions of the Agreement, constituting Chapter III of the FTZ, are to be implemented in accordance with the principles of technical knowledge and with: 5.1. the dimensions of the works specifying the type, method of execution and number of works to be carried out – constituting Chapter V of the FTZ, 5.2. Technical Specifications for the Execution and Acceptance of Construction Works for specific industries, which constitute Chapter VI of the FTZ, 5.3. conditions resulting from technical regulations and activities listed in Article 22 of the Construction Law Act of 7 July 1994 (Journal of Laws No. Journal of Laws of 2026, item 524 as amended) – hereinafter: Construction Law, and its implementing regulations, 5.4. The description of the subject-matter of the contract, constituting Chapter IV of the FTZ, 5.5. the requirements resulting from current Polish Standards and technical approvals, 5.6. the conditions resulting from the provisions of the Act of 16 April 2004 on construction products (Journal of Laws No. Journal of Laws 2021, item 1213) and the Regulation of the Minister of the Interior and Administration of 7 June 2010 on fire protection of buildings, other construction works and areas (i.e. Journal of Laws 2023, item 822 as amended), 5.7. the conditions resulting from the provisions of the agreement constituting Chapter III of the FTZ. The Contracting Authority allows the possibility of introducing changes to the provisions of the contract constituting Chapter III of the FTZ, in relation to the content of the tender on the basis of which the Contractor was selected in the cases indicated in the provisions of the contract Chapter III of the FTZ, 5.8. Only new products of domestic and foreign producers must be used to carry out the works. Products authorised and used in construction should be used. All materials and equipment specified in the description of the bill of quantities of works must comply with the requirements set out in Article 10 of the Construction Law Act and in the Construction Products Act of 16 April 2004 (Journal of Laws No. Journal of Laws 2021, item 1213) and hold a safety mark certificate for products subject to that certification. For other materials - with the exception of the provisions in force in this respect concerning the determination of the list of construction products that do not have a significant impact on the fulfilment of basic requirements and products manufactured and used according to recognized principles of construction art - have a national declaration of performance with a reference document, which is the Polish Standard, or in its absence - a national technical assessment (KOT) or have a declaration of performance with a reference document, which is the European t-assessment
