… the Food and Nutrition Safety Act of 25 August 2006 (Journal of Laws 2023, item 1448) in connection with Regulation No 852/2004 of the European Parliament and of the Council of the European Union of 29 April 2004 on the hygiene of foodstuffs (Annex 2 to the Regulation), by which it will deliver the subject-matter of the contract. The customer can always control the conditions in which the products are transported. In the event of failures, the Ordering Party reserves the right to refuse to accept the products. 5. The contractor must have the HACCAP system implemented in the production and marketing of the assortment listed in the FTZ, i.e. hold a document issued by the authorities authorised to officially control food or a company authorised to carry out certification stating that the HACCAP system is used. 6. The food supplied must be marked with a conspicuous, legible and indelible identification code and an expiry date enabling the food from the production batch to be identified, assigned by the manufacturer and allowing its traceability, in accordance with the applicable food law. 7. CAUTION 1) In accordance with the Act of 13 June 2013 on the management of packaging and packaging waste, Chapter 6b ‘Refund system’ (consolidated text: Journal of Laws 2025, item 870) a deposit is added to the packaging covered by the deposit system. The deposit is not the price of the goods, it is non-taxable and is subject to settlement when returning the packaging. 2) Packaging to be returned must be marked with the logo of the deposit and return system, specified in the annex to the Act of 13 June 2013 on the management of packaging and packaging waste and implementing acts issued on the basis thereof (consolidated text: Journal of Laws 2025, item 870) . 3) The Ordering Party undertakes to return return returnable packaging in a condition allowing its reuse and the Contractor is obliged to collect empty returnable packaging delivered under the contract. 4) Each delivery will be confirmed by a WZ document (External Issue) or another delivery document containing: the quantity of beverages delivered, the quantity of returned packaging covered by the deposit, the value of the deposit for packaging. The amount of the deposit for packaging is determined by the Contractor's current price list, which is attached to the Contract. 5) The return shall be made on subsequent deliveries or on the date agreed by the Parties. 6) The number of returned packages will be confirmed on the receipt document or correcting invoice. 7) Deposit settlement: The deposit for returnable packaging will be shown on the invoice separately from the price of the beverages. The return of the packaging results in a corresponding reduction in the amount due or the issue of a correcting invoice. In the event of failure to return the packaging by the end of the contract, the Contractor shall have the right to retain the deposit collected. 8) If the packaging was produced before the introduction of the deposit system (1 October 2025) and is not marked with a deposit label, it is not covered by the refund of the deposit. 9) For the purpose of comparing offers and selecting the most advantageous offer, the Ordering Party requires the Contractor to complete the Offer Form, in accordance with the table, assuming that all of you
