… contracting authority requires that the acquisition, reproduction and distribution of the software offered for the performance of the public contract in question must not infringe the intellectual property rights of any third party and must comply with the Law of 4 February 1994. – on copyright and related rights (Journal of Laws 2025, item 24 as amended), by the Act of 30 June 2000. Industrial property law (Journal of Laws 2023, item 1170) and other applicable provisions of Polish law. The contracting authority also requires that the software manufacturer’s certificates and labels attached to the software offered and other software components are original and that the software is new and has never been used before.
