Documents and requirements for assessing the suitability of the tenderer and the absence of grounds for exclusion https://www.evergabe-online.de/tenderdetails.html?id=889959&criteriaId=51062 12. Award Criteria 50 % Price 50 % Performance Exclusion and evaluation criteria are used to measure performance in the Criteria Catalogue. In addition, a quality/performance assessment is carried out as part of a sampling. 14. Other information 1. The tenderer must provide self-declarations and any supporting documents in order to prove his expertise and ability to perform and to prove that there are no grounds for exclusion pursuant to Sections 123 and 124 of the Act against Restrictions of Competition (GWB). For the self-declarations, the form ‘Tenderer's information on selection criteria’ attached as Annex B-03 must in principle be used. Alternatively, the Single European Self-Declaration (Single European Self-Declaration) can be used as an ‘Aptitude Criteria for Bidder Information’ under Section 35(3) of the Lower Threshold Award Regulation (UVgO) in conjunction with Section 50(1) of the Public Procurement Regulation (VgV). The contracting authority requests the documents not submitted with the EEE in accordance with Paragraph 35(3) of the UVgO in conjunction with Paragraph 50(2) of the VgV. If an undertaking has grounds for exclusion pursuant to Paragraph 31(1) of the UVgO in conjunction with Paragraphs 123 and 124 of the GWB, it shall not be excluded from the procedure if the tenderer proves that sufficient self-cleaning measures have been taken pursuant to Paragraph 125 of the GWB. If selection criteria are defined as minimum requirements, e.g. a self-declaration of at least 3 comparable references, the lack of evidence leads to exclusion from the procedure. If, for legitimate reasons, the tenderer is unable to produce the documents or attestations required, it shall be sufficient to produce other documents, provided that they are also capable of substantiating the tenderer’s suitability and the absence of grounds for exclusion. If the tenderer is not a domestic tenderer, equivalent certificates from the country of origin will suffice. If such certificates are not issued in the country concerned, they may be replaced by an oath-based insurance policy. In states where there is no insurance on oath, this can be replaced by a formal declaration. Documents not written in German must be accompanied by a certified translation into German. The contracting authority collects information from a credit reference agency on tenderers whose tender is eligible for a contract in the context of random sampling. If information or other characteristics are available that indicate an above-average probability of default of the company, the contracting authority will give the tenderer the opportunity to check the information for its factual accuracy and, if necessary, to present objections and corrections. Tenderers must prove that they meet the selection criteria laid down by the contracting authority for the proper performance of the contract and that they have not:
