Procurement documents ‘Learning support at the Teltow-Fläming Basic Education Centre 2027-2028’

The minimum requirement is a teacher qualification in basic education/literacy (e.g. teacher training in German/DAF/DAZ, adult education, relevant pedagogical training, plus further training such as "Pro Grundbildung", BAMF literacy or similar and/or proven teaching experience in literacy/adult education).
On the scope of the contract (Scope): Two lots (lots 1 and 2) are tendered for learning support in the learning studio Ludwigsfelde (Potsdamer Str. 109a) in the district of Teltow-Fläming.
Each lot consists of 5.5 hours per week, of which at least 5 hours are open at the place of learning; the contract runs from 01.01.2027 to 31.12.2028.
The main place of performance is the learning studio Ludwigsfelde, but services can affect the entire district (seeking learning opportunities, advice in the district, networking).
In terms of content, the assignment includes learning guidance and support in open learning opportunities (70-80%), project documentation and monitoring (5-10%), networking and public relations (5-10%), as well as in-house professional development (at least two training courses per year in the field of literacy/basic education).

For award criteria and evaluation: Since fixed prices are set (fee rate of at least EUR 43 per hour for qualified teachers), the most economical offer is determined primarily by qualitative criteria.
The formal qualification is decisive; it will be assessed on the basis of a scoring scheme: seven equally weighted criteria with 0-4 points each (basic pedagogical qualification, type and scope of further training, relevant professional experience, knowledge of current teaching concepts and funding instruments, oral and written communication skills/German, counselling and intercultural competence, knowledge of the socio-spatial conditions in Teltow-Fläming).
The sum (max. 28 points) is the qualification level.
The contract for each lot will be awarded to the tenderer with the highest score; in the case of the same qualification levels, the lot procedure shall be decided.
If necessary, already proven quality from previous basic education projects will be included in the qualitative assessment.
On risks and special conditions: The procurement procedure is subject to the UVgO application conditions, VOL/B and the Additional Contractual Conditions of the State of Brandenburg (ZVB-Bbg).
Fixed prices apply; Mixed calculations are inadmissible and lead to exclusion.
The contractor must provide at least 80% of the agreed timeframe; Repeated or permanent failure to comply shall be considered a breach of contract and may result in the adaptation or termination of the fee contract.
Form 5.3 requires the payment of a minimum salary (currently EUR 13 gross/hour) to employees, proof of wages and salaries, toleration of checks and provides for contractual penalties of up to 5% of the order amount (maximum EUR 250,000) as well as a right of termination of the contracting authority in the event of infringements.
Subcontractors may only be used with the consent of the contracting authority; where subcontractors and distributors are involved, the same minimum remuneration and control obligations apply.
The ZVB/VOL-B also regulates, among other things, contractual penalties in the event of missed deadlines (up to a maximum of 8 %), possible securities (from EUR 50,000 contract value), duties of care, liability for defects, set-off rights, restrictions on assignment and jurisdiction; however, an obligation to provide security has not been specifically agreed here.
A mandatory on-site visit cannot be found in the documents.
On possible contradictions/clarifications: The order of precedence of the elements of the contract is clearly defined: The first criterion is the tender with specifications and annexes, then any supplementary contractual conditions, then ZVB-Bbg and finally VOL/B.
There are no conflicting statements on consortia, subcontracting or ancillary tenders; the UVgO classification with the relevant forms (4.2, 4.3, 4.4) applies, which are only to be attached if corresponding constellations are available.
In case of doubt, due to the precedence established, the terms of reference, supplemented by the specific formal requirements in Forms 3.4 and 5.3.
