Vergabeunterlagen für Schulprojekte „Türöffner: Zukunft-Beruf 2022“ im Landkreis Havelland

The input text concerns a public procurement procedure under German and Brandenburg law for the planning and implementation of school projects to strengthen pupils’ competences within the state programme „Türöffner: Zukunft-Beruf 2022“ in the Landkreis Havelland.

The legal and contractual framework is based on German federal rules (GWB, VgV, UVgO, Mindestlohngesetz, Lieferkettensorgfaltspflichtengesetz, VOL/B) and the Brandenburgisches Vergabegesetz, so the country point of view is explicitly Germany (Bundesrepublik Deutschland) and the federal state of Brandenburg.

Such as indicated in the list of “Anlagen”, bidders must submit a comprehensive set of standardised forms and declarations.

These include: the price sheet 2.01 for each lot, the offer letter 2.02, the reference self-declaration 2.03 (at least one completed, relevant school-project reference from the last three years with details on client, content, period, place, participant numbers and contact), FB‑1‑01 on §§ 44, 45 VgV (company data and proof of professional authorisation, including Gewerbeanmeldung/Handelsregister, IHK/Handwerkskammer membership and business/professional liability insurance, or declaration to take out such insurance in the event of award), FB‑1‑02 on non‑existence of exclusion grounds (§§ 123, 124 GWB) with the possibility of self‑cleaning under § 125 GWB, and FB‑3‑06 on compliance with minimum requirements under the Brandenburgisches Vergabegesetz (in particular minimum wage and documentation obligations).

Where subcontractors or “Eignungsleihe” are used, corresponding forms for these third parties (FB‑4‑01, FB‑4‑02, FB‑4‑04, FB‑4‑05, FB‑4‑06) are also required.

For example, Los 1 targets two classes of approx. 25 apprentices each (AUO 24a and 24b) in the third year of training in ophthalmic optics, with project days in calendar week 49 or 50 (Wednesday or Friday) aligned to the school timetable (blocks of double lessons).

The content focuses on personal, social and methodological competences around professional customer contact and exam situations.

Other lots (Los 2, Los 3) have their own, separate Leistungsbeschreibung files; the total quantity, number of double lessons and specific content per lot are set there.

The overall tender DI‑ZVSt‑JS‑09/2026 is structured into several lots, and offers may cover multiple lots but not necessarily all.

Such as stated in the Angebotsaufforderung, the award is made to the “wirtschaftlichste Angebot” (most economically advantageous tender).

The prerequisites are that all minimum requirements are fulfilled and all required documents are properly and completely submitted.

Show all 23 statements

The detailed award criteria and their weighting/order are set out in document 4.02 „Bewertungsvorgehen und Zuschlagskriterien“ (not reproduced in the excerpt, but explicitly referenced).

Nebenangebote are explicitly not permitted: although the template contains both options, the checkbox ☒ is set at “Nebenangebote sind nicht zugelassen”, so only main offers conforming to the specifications are allowed.

Such as shown in VOL/B and the BbgVergG agreement, there are several contractual risks and special conditions.

VOL/B Teil B becomes part of the contract and regulates, among other things, changes to the scope (§ 2), obligations and liability for performance (§§ 4, 7, 10), delay and termination rights for both sides (§§ 5, 8, 9), contractual penalties (§ 11, e.g. max. 0.5 % per week of the non‑usable part of the performance, up to 8 %), quality checks and acceptance (§§ 12, 13), invoicing and payment (§§ 15–17), and possible security (guarantees) from about 50,000 EUR order value (§ 18).

The BbgVergG agreement FB‑3‑06 imposes minimum hourly wages (currently at least the higher of 13.00 EUR BbgVergG minimum or 13.90 EUR MiLoG from 1.1.2026) and extensive control and documentation duties, with contractual fines of 1 % of the contract sum per proven case (up to 25,000 EUR per case; cumulative maximum 5 % and 250,000 EUR) for wage underpayment or obstruction of controls, both for the bidder and, via mirrored commitments, for subcontractors and temporary‑work providers.

Additionally, the Auftraggeber has a contractual right of termination if these obligations are violated, and bidders must ensure that subcontractors meet reliability, capability and legal compliance requirements and may only be replaced with the client’s consent.

Such as highlighted in the hierarchy clause of VOL/B § 1 and the tick‑box logic of the tender letter, apparent contradictions are resolved by clear precedence rules.

VOL/B § 1 specifies that in case of conflicting statements the order of precedence is: (a) Leistungsbeschreibung, (b) Besondere Vertragsbedingungen, (c) Ergänzende, (d) Zusätzliche Vertragsbedingungen, (e) technical contract conditions, and only then (f) VOL/B.

Therefore, if a statement in the general VOL/B terms diverges from a specific clause in the Leistungsbeschreibung or special conditions, the more specific, higher‑ranked document applies.

Within the Angebotsaufforderung itself, generic wording such as “Nebenangebote sind zugelassen” is overridden by the checked option “Nebenangebote sind nicht zugelassen”.

Similarly, while different submission modes (electronic in text form, with advanced/qualified signature, or paper) are mentioned, the concrete, ticked allowances and the e‑Vergabe platform instructions govern the valid form in this procedure.

Foreign bidders

In Germany · Business services, 349 contracts went to foreign companies over the last 3 years (of 29,674 recorded awards) — mostly from Belgium, Italy, United Kingdom.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
