The input text concerns a Belgian public procurement procedure launched by the Centre Hospitalier Universitaire (CHU) de Liège for a media partnership and communication services. It is clearly written from the point of view of Belgian public procurement law and practice (references to the Loi du 17 juin 2016, AR du 18 avril 2017, AR RGE du 14 janvier 2013, Conseil d’État, etc.), so the relevant country is Belgium. The contracting authority is a Belgian university hospital; the procedure is a “procédure négociée directe avec publication préalable”, with electronic submission via the federal e‑procurement platform.

Such as concerns “what the bidder must submit”, the input specifies that the tenderer must complete the official Formulaire d’offre (Annexe A), the Inventaire (Annexe B) in both PDF and XLS formats, and attach all annexes listed at the end of the cahier des charges (including Annex C – certificat de bonne exécution, Annex D – confidentiality charter, Annex E – data protection convention). The bidder must also provide company statutes and documents proving signing powers, a list of board/management members, and, for groupings, the internal solidarity agreement designating the representative. Additionally, the bidder must include all documents required for qualitative selection (section II.6), any third‑party capacity commitments, and any information it considers useful. Offers must be drawn up in French, respect the provided file formats, and be signed with a qualified electronic signature on the e‑procurement platform report de dépôt; absence of such a signature is a substantive irregularity.

Such as regards minimum qualification requirements, the text details exclusion grounds (fiscal and social debts, other mandatory and optional exclusions) and requires evidence of being in order with social security and tax obligations, via Télémarc or, failing that, official attestations for the last quarter/last fiscal period. For the top‑ranked tenderer, the contracting authority may request recent criminal record extracts or equivalent, and an attestation from the commercial court proving no bankruptcy. On technical/professional capacity, bidders must provide at least three references from the last three years in institutional communication strategy, multimedia content production, and/or multi‑support media diffusion, specifying client, project, amount, year and proof of good execution (Annexe C). They must have a dedicated team with at least one project manager, one audiovisual expert and one digital specialist, described via CVs, experience and tools/equipment. They must demonstrate certified media audience, notably CIM (or equivalent) reports less than 12 months old showing at least 50,000 daily contacts in the province of Liège for selected daily press titles, with geographic breakdown; equivalence and reliability must be justified for certifications other than CIM. Groupings can pool capacities and, where third‑party capacities are decisive, these entities must commit in writing to make their means available and accept joint liability.

Such as concerns the scope of the contract, the object is the design and implementation, for one year, of a multi‑support communication, diffusion and acquisition strategy for CHU de Liège, including content production, media centralisation, and promotion via digital and traditional supports. Place of performance is the CHU de Liège (Avenue de l’Hôpital 1, 4000 Liège). The contract is unique and indivisible: no lots, no variants (free or required), and no options (free or required) are allowed. The contract duration is one year, starting the day after award notification. While detailed quantities are referenced in the technical section IV (strategy and content, media partnership, partner media and diffusion, social networks, KPI and reporting), the financial structure is a global price in euros (two decimals), inclusive of all costs except VAT (administrative management, travel, insurance, documentation, delivery of documents, packaging, training, safety and health measures, and all elements indispensable to proper functioning). Prices are not subject to index‑based revision (explicit non‑revision per article 38/7 AR RGE), although general AR RGE clauses on contract modifications and re‑examination are reproduced for execution.

Such as regards award criteria and weighting, the contract is awarded, after possible negotiations and a BAFO, to the economically most advantageous regular offer, based on: 1) Price – 50 points, calculated by the formula [lowest price / analysed price] × 50; 2) Production – 10 points, evaluating the ability of a single provider to ensure regular, scheduled production, respect deadlines, guarantee continuity (backup, internal organisation), consistency of diffusion frequency across supports, and event‑related notoriety; 3) Quality – 12.5 points, assessing relevance and professionalism of proposed content, respect for CHU graphic/editorial/institutional charters, clarity and precision of messages, added value relative to communication objectives, and prior examples/references; 4) Videos – 7.5 points, assessing audiovisual production mastery, technical quality (image, sound, editing), formats adapted to social media, website, internal communication, and responsiveness to requested changes; 5) Supports proposed – 10 points, examining diversity and pertinence of supports (print, digital, web, social networks, dailies), accessibility and readability for all target audiences, and alignment with expressed needs; 6) Originality – 10 points, focusing on creativity and innovative solutions tailored to the institutional context and audience, combining innovation with public communication codes. Minimum requirements and award criteria are explicitly non‑negotiable, though the authority may choose not to negotiate if initial offers are sufficiently complete.

Such as concerns risks and special conditions, several points are emphasised. Subcontracting is permitted but controlled: if capacities of other entities are used for selection, the bidder must state for which part of the contract and provide the commitment of those entities; any intended subcontracting must identify the subcontracted part and the subcontractor’s details. There are specific data‑protection obligations via Annex D and E and detailed clauses about security, supply chain controls, and standard contractual clauses (CSS, 4 June 2021) for data transfers outside the EU. Insurance obligations are listed under “Assurances” (III.3.1), and a financial guarantee/cautionnement may apply (III.3.2). The bidder is bound by its offer for 90 days from the submission deadline; the same 90‑day validity applies to negotiated offers and BAFO. Questions must be submitted exclusively via the publicprocurement.be forum by 12/11/2026 (at the latest six days before the offer deadline), and any discrepancies or omissions in the documents must be signalled at the latest ten calendar days before the offer deadline. Offers must be lodged solely via the e‑procurement platform before 23/11/2026 at 10:00; late or non‑electronic offers are not accepted. There is no public opening session. A key risk is the strict regime of penalties and delay fines: general AR RGE penalties apply, plus special penalties of €100 per calendar day of delay from day one, 4% of the initial contract amount per breach of data‑processing instructions and per data‑protection breach by subcontractors, and AR RGE delay fines of 0.1% per day (capped at 7.5% of the value of delayed services). Moreover, in derogation from AR RGE article 70, the supplier cannot slow or stop services due to late payment because of hospital activity continuity; payment terms are verification within 30 days then payment within 30 days, provided a correct invoice is received, and advances can be granted to SMEs under specific legal conditions.

Such as concerns contradictions or corrections in the documents, the text itself gives a clear conflict‑resolution rule: bidders are required by article 81 AR 18/04/2017 to signal any discordances, errors, inconsistencies or imprecisions detected, at the latest 10 days before the offer deadline, via the electronic forum. The CHU then publishes clarifications or rectifications, which become part of the contract documents and must be taken into account when preparing the offer. The cahier des charges also states that the bidder is deemed to have taken into account all legal modifications effective up to the fifth day before the deadline and all relevant notices and rectifications published in the Bulletin des Adjudications. By submitting an offer, the bidder formally accepts all conditions of the cahier des charges and waives its own terms of sale, even if annexed to the offer. In case of apparent contradiction between a general regulatory reference and specific derogations (for example the non‑application of AR RGE article 70 on slowing execution in case of late payment), the explicit derogation in the cahier des charges applies. Similarly, if there are omissions in the inventory, the bidder must raise them before the deadline; failing that, it cannot later claim those omissions during contract execution, and the inventory as corrected by any published clarifications is the binding reference.

Foreign bidders

In Belgium · Business services, 729 contracts went to foreign companies over the last 3 years (of 3,120 recorded awards) — mostly from France, Germany, Italy.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
