Overheidsopdracht Fedasil Zoutleeuw – aankoop Sinterklaas-snoepgoed
The input text concerns a Belgian public procurement procedure launched by Fedasil (Federaal Agentschap voor de Opvang van Asielzoekers) for the purchase and delivery of Sinterklaas chocolate figures to the Fedasil reception centre in Zoutleeuw.
It is clearly situated in the Belgian legal framework on public procurement (wet van 17 juni 2016, KB’s van 2013, 2017 en 2024), and all provisions, criteria and conditions are described from the point of view of a Belgian contracting authority.
No other countries are mentioned.
The documents, such as the “Offerteaanvraag”, Bijlage B (inventaris/prijslijst) and Bijlage C (technische specificaties), together define what the bidder must submit and the scope of the contract.
The bidder must, such as indicated in the section on “Conformiteit van de offerte”, submit an offer that is signed by a person authorised to bind the company economically and that contains all requested information and annexes (e.g. completed price inventory in Bijlage B, any requested technical fiches).
There is explicit permission to add general sales conditions, provided these do not contradict Fedasil’s administrative and technical conditions; any contradictory clause will be considered null.
The text does not mention specific minimum qualification requirements like references, turnover thresholds, insurance certificates or other selection criteria, so beyond formal compliance and conformity with the technical specs, no extra qualification evidence is described.
The scope of the contract is defined very concretely in Bijlage C and Bijlage B. The contract concerns, such as specified, the purchase and delivery of “snoepgoed” consisting of two chocolate figures (Sinterklaas and Piet) in one packaging, with a minimum total weight of 185 grams, at least 14 cm per figure, without pork gelatine, and to be delivered at the latest on 01/12/2026.
Bijlage B states the estimated quantities: 45 units of snoepgoed and 1 unit of “verzendkosten voor Sint-Truiden” for one year, with the bidder to fill in unit prices, totals without and with VAT.
The place of performance is Fedasil Zoutleeuw, Zoutleeuwse Steenweg 11, 3440 ZOUTLEEUW, and the contract type is a “one shot” delivery: the performance period effectively ends with the complete delivery by 1 December 2026.
Award criteria and price determination are described in a straightforward way.
The gunningscriterium is, such as clearly stated, exclusively the lowest price, based on the total amount of the inventory/offer in Bijlage B (global price).
Show all 26 statements
The quantities are treated as forfaitair (fixed), with a “opdracht met globale prijs”.
There is no mention of qualitative criteria or weighting between multiple criteria: no points for quality, sustainability, or delivery times beyond the fixed latest delivery date.
This is an “overheidsopdracht van beperkte waarde” under article 92 of the Belgian law, with estimated value under 30,000 EUR excl.
VAT, which explains the simplified procedure and single price criterion.
Risks and special conditions are addressed mainly through references to general execution rules and specific clauses.
The applicable KB of 14 January 2013 provides, such as mentioned, rules on payment modalities, penalties for delay, detection of execution errors and unilateral measures by the contracting authority, though formalities are simplified (PV’s and measures can be notified by e-mail instead of registered letter).
Prices are fixed for the whole duration (no price revision allowed).
The validity period of offers is 30 calendar days from the submission deadline; the same applies to any BAFO in case of negotiations.
Payment occurs within 30 calendar days after receipt of deliveries and a properly drawn-up invoice, which must be sent by post or e-mail to the bookkeeping service at Fedasil Zoutleeuw.
There is no requirement for guarantees or explicit rules on subcontracting in the text, and no place visit or information session is foreseen.
A detailed GDPR/confidentiality clause imposes compliance with EU and Belgian data protection rules and outlines cooperation with Fedasil’s DPO.
With respect to contradictions or corrections, the documents are largely consistent and repetitive, with the main elements (scope, quantities, place, date, price criteria) restated identically.
Minor textual variations, such as references to “snoepgoed” versus “snoepzakje” and a small spacing error in the year “01/12/2 6”, do not create substantive contradictions; the clearly intended date is 01/12/2026, and the product description in Bijlage C governs the technical scope.
Where there could be a potential conflict—such as a bidder’s general terms contradicting Fedasil’s conditions—the tender explicitly states that Fedasil’s administrative and technical conditions prevail and that contradictory clauses in the bidder’s terms are void.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
