Public contract for renewing and maintaining fire detection and alarm systems for Stad Tienen (BE)
The input text concerns a Belgian public procurement procedure (Stad Tienen / OCMW / AGB Tienen) for a mixed framework contract regarding the supply, installation and maintenance of fire detection and alarm systems in municipal buildings.
It is clearly drafted from the point of view of Belgian public procurement law, explicitly referring to the Wet Overheidsopdrachten, the Belgian KB Plaatsing and KB Uitvoering, and EU eIDAS rules.
Countries explicitly mentioned are Belgium (Belgian legislation, Belgian eID, Belgian judicial and administrative authorities) and EU Member States in the context of social security and certificates; the perspective is that of a Belgian contracting authority applying EU/Belgian procurement rules.
Regarding what the bidder must submit and the minimum qualification requirements, the text specifies, such as in the section on “Uitsluitingscriteria” and “Technische en beroepsbekwaamheid”, that bidders implicitly declare they are not in an exclusion situation and must attach, for Belgian bidders, a criminal record extract less than 6 months old, plus for Belgian bidders employing staff under another EU social security regime a recent foreign social security attestation.
In addition, the offer must contain the completed official offer form (offerteformulier) with identity and price details, the fully completed inventory/meetstaat (both as native and PDF), documents proving signatory powers (statutes, powers of attorney, etc.), documents for the evaluation of exclusion and award criteria, and any evidence of corrective measures if an exclusion ground applies.
Offers must be drafted in Dutch, submitted exclusively via the new e‑Procurement platform, finalised through the “Verzenden” button, and signed with a qualified electronic signature by all authorised persons (for joint bids: each partner).
For foreign entities, an electronic seal alone is not valid; for Belgian entities, an electronic seal may be acceptable per Belgian law.
On the scope of the contract, the text explains that this is a mixed contract (gemengde opdracht) and a framework agreement with a maximum value of EUR 200,000 excl. VAT.
As such, for Deel A it is a global price contract covering the full installation on certain known sites, and for Deel B it is a price list contract with indicative quantities, ordered according to need over the framework’s duration.
The scope includes, such as described in the inventory, the design, supply, installation, programming, risk assessment, coupling with other systems, maintenance and interventions of branddetectie- en brandalarminstallaties in “all buildings of Stad Tienen where needed”, with several concrete sites listed already (e.g.
Bibliotheek Tienen – replacement; OC Kumtich – new installation; Hal 4 – new installation; WZC Keienhof).

Deel A is based on a mandatory site visit, where the contractor must verify existing conditions, access constraints, measurements, and quantities, and must complete and, where necessary, supplement the inventory.
The period of binding of the tender is 90 calendar days from the deadline for receipt of offers; the text also indicates that the framework ends automatically when the maximum value is reached.
Execution rules, delivery, inspections, provisional and final acceptance, warranty periods and payment modalities are governed by the KB Uitvoering, unless the special specifications deviate (here explicitly: no deviations).
Concerning award criteria and their weighting, the contract is awarded via a “vereenvoudigde onderhandelingsprocedure met voorafgaande bekendmaking” based on the most economically advantageous tender (best price‑quality ratio).
The pricing criterion weighs 60 points, scored using a proportional formula (score = price of lowest bid / price of bid × weight).
Additional qualitative criteria are specified, such as “Plan van aanpak” (15 points) and at least two more criteria (including “Opleidingen”) so that total weighting equals 100.
For the training criterion, the contracting authority evaluates the content and form of the proposed training and instruction cards for end users and the permanent duty team, e.g. clarity, logical structure, use of photos, and methodology.
Qualitative criteria 2, 3 and 4 are scored using qualitative scales (undermaats, onvoldoende, matig, voldoende, goed, zeer goed, grote meerwaarde) mapped to 0–100% of the criterion’s weight, with “undermaats/afwezig” leading to a substantial irregularity and rejection.
The text stresses that the contract will be awarded to the tender that offers the economically most advantageous regular offer, taking all weighted criteria into account, and that the authority may negotiate and request revised offers, restarting the validity period each time.
With respect to risks and special conditions, the documents stipulate, such as in the chapters on place visits, sanctions and insurance, that a place visit is mandatory for Deel A and will also precede each subsequent order under Deel B, with the contractor fully responsible for checking all site conditions and quantities; no later price increases will be accepted for foreseeable difficulties or unmeasured works without explicit written order.
No bid submitted on paper or by e‑mail is valid or regularisable; only electronic submission via e‑Procurement is permitted.
The contractor must hold appropriate insurance for occupational accidents and civil liability towards third parties and must be able to present attestations within 15 days upon request.
No performance bond (borgtocht) is required.
Sanctions and remedies follow KB Uitvoering Articles 44–49: the contractor is deemed in default when performance does not comply, does not progress sufficiently to meet deadlines, or when valid written orders are not followed; the authority reserves rights to apply penalties, liquidated damages, or unilateral measures.
The bidder, by submitting, accepts all clauses of the specifications and waives its own general conditions; any reservations or non‑compliance with these clauses leads to a substantial irregularity and exclusion.
As for contradictions or corrections within the documents, the presence of an “erratum” document (05‑…‑err) indicates corrections to the original specifications (03‑…).
Where there is overlap between the two documents, the erratum version should be followed as the applicable one, such as for the corrected section references (e.g.

Tactics
When contracts were awarded in this country and sector, usually about 3 bids came in. A normal field for this market. (Based on 249 completed awards — not a statement about this procedure.)
This procedure allows 51 days between publication and deadline — typical in this country is 34 (median of 3,233 procedures). Much more generous than usual — time for a thorough bid rather than a quick one.
Foreign bidders
In Belgium · Electrical machinery, 90 contracts went to foreign companies over the last 3 years (of 423 recorded awards) — mostly from France, Germany, Netherlands.
