Tender for N280 Cycle Track and Sidewalk Works in Wallonia

The input text concerns a Belgian public works contract launched by the Service public de Wallonie (SPW), Direction des Routes du Brabant Wallon, for road infrastructure on the N280.

The point of view is clearly Belgian: the documents refer extensively to Belgian laws on public procurement, contractor agréation, labour welfare, insurance, and civil code provisions, as well as Walloon decrees and technical standards (CCT Qualiroutes, Qualiroutes reference documents).

It also mentions EU law on data protection and public procurement but always as applied by Belgian and Walloon authorities.

Such as regarding participation and minimum qualifications, the bidder must be an entrepreneur agréé under the Belgian law of 20 March 1991, in category C or sub‑category C5, class 5, or demonstrate equivalent status via foreign official lists or supporting documents if not agréé.

The offer must be submitted electronically via the Belgian “e-Procurement / e‑Tendering” platform, with a qualified electronic signature on the dépôt report.

The bidder must use and fully complete the official “Formulaire d’offre” and “Métré récapitulatif” (now provided also in XLS per Avis rectificatif n°1) and attach: proof of signing authority (Moniteur/statuts or procuration), declaration for fair competition and against social dumping (for CP 124), list of annual holidays and compensatory rest days, list of subcontractors and their shares, all documents required by the Plan de sécurité et de santé (PSS) including planning, technical fiches, quality-plan engagement (Qualiroutes A‑1), and any documents needed for qualitative selection (agréation proofs for non‑agréés).

Such as concerning the scope and execution of the contract, the market is a single lot, mixed-price works contract for civil engineering on the N280 in Wallonia: Part 1 in Hennuyères (Braine‑le‑Comte) for a cycle track between BK 0.0–0.9 and 3.0–3.4, and Part 2 in Virginal (Ittre) for a cycle sidewalk between BK 3.40–4.03 and a signalised junction (“carrefour à feux”).

The exact quantities and technical items are in the Métré and CCT Qualiroutes technical clauses, with annexes listing posts subject to technical reception, demolition-material quantities, and price revision formulae.

The execution period is set at 120 working days from the order of service; bidders remain bound by their offer for 180 calendar days from opening.

The site organisation includes mandatory site offices (30 m² pavilion with specified equipment), topographic surveys, as‑built plans compatible with Mensura/AutoCAD/PDF, regular plannings (overall and short‑term every 2 weeks), state-of-the-art execution under CCT Qualiroutes, and a detailed safety and traffic signalling scheme approved at least 15 days before each phase.

Such as for award criteria and pricing, the contract is awarded to the economically most advantageous tender based solely on price; there is no weighting on qualitative criteria beyond selection.

Prices combine global (for lump-sum elements) and bordereau-unitary components; unit prices include all charges except VAT and explicitly cover: site organisation, required studies and topography, insurances, and all measures made mandatory by government for sanitary, security or political reasons adopted before the tenth day preceding the offer deadline.

Price revision is governed by a modified formula under Article 38/7 using an adapted index “I adapté” based on the “I‑2021” index evolution, justified by the lack of TP reference prices, with all other parameters per CCT Qualiroutes.

Such as with respect to risks, guarantees, subcontracting and special conditions, the bidder must provide: a main performance bond (cautionnement) of 5% of contract value and an additional bond of 10% of the total of posts subject to post‑factum technical reception (listed in annex to the Métré).

Insurance obligations are extensive: accidents at work (including commute) with waiver of recourse against the authority; civil liability covering contractor, staff, subcontractors, client and third parties including neighbour-disturbance; and a mandatory “responsabilité décennale” insurance covering structural risks and certain third‑party damages for 10 years after provisional acceptance, with specific caps, franchise limits (max 5%), and direct indemnification to the authority.

Subcontracting is capped at two levels in the chain; the contractor must declare in the offer the portion subcontracted and named subcontractors (Annexe 3) and later provide detailed identity and legal representatives for all subcontractors, maintaining updates, and ensuring CP 124 subcontractors sign the anti‑dumping declaration.

The authority may suspend works for adverse weather, safety or operational reasons without indemnity (with signalisation at contractor’s cost), and special clauses allow cost compensation for unforeseen government health/security measures (Article 38/9), subject to RGE procedures; modifications, replacements of adjudicataires and judicial recourse follow Belgian RGE and Council of State rules.

Such as regarding penalties, time validity and procedural risks, Article 45 is heavily supplemented: penalties apply systematically to safety and traffic-signalling failures, with unique penalties per infraction and multiplicative factors in case of recurrence; technical deficiencies accepted with less‑value result in both penalties and price reductions; and specific penalty grids cover: non‑respect of soft-mobility circulation (250–500 € per half‑day), delays in declarations of claim, provision of site offices and equipment, transmission of survey reports, as‑built plans and final accounts, monthly planning updates (500 €), and installation of information panels (75 €/day).

The contractor must weekly declare days lost to bad weather (≥4 consecutive hours) for potential deadline adjustments; failure invalidates the claim, and signalisation beyond contractual periods is not covered by the authority.

The contract also binds the offer for 180 days, provides advances for SMEs (5–20% depending on size), and specifies that disputes fall under Belgian law and the courts of Brabant Wallon.

Such as concerning contradictions, corrections and which statements prevail, the AVIS RECTIFICATIF n°1 adds a previously missing Métré récapitulatif XLS; this rectificative notice and any other published notices form an integral part of the tender documents and must be taken into account, so where they modify or supplement earlier documents, the rectified wording applies.

Any substantial change in site conditions between offer opening and start of works must be notified by registered letter before works start, otherwise later claims are null, which is a critical risk and clarifies that the version of conditions at the time of notification and accepted adjustments takes precedence.
