Public works tender for noise barriers at Dison (Wallonia)

The input text concerns a Belgian public works contract for the “Installation de nouveaux écrans antibruit à hauteur de Dison” on an autoroute in Wallonia, under SOFICO/SPW Mobilité et Infrastructures.

It is written from the point of view of Belgian public procurement law (loi du 17 juin 2016, AR 18/04/2017, AR 14/01/2013) and Walloon technical standards (Qualiroutes, WALTOPO), and refers to Belgian institutions (SPW, SOFICO, Conseil d’État, Médiateur de la Wallonie).

Such as regards what the bidder must submit, the offer must be introduced electronically via e-Procurement, in French, using the prescribed “OFFRE” and “METRE RECAPITULATIF” forms.

The bidder must attach at least: the completed form of offer and métré récapitulatif, company statutes or Moniteur extracts proving signing authority, any power of attorney for a mandataire, the declaration for fair competition and against social dumping (annexe 4), the planning of the works, the list of subcontractors and their share, documents required for qualitative selection, the safety-and-health related documents (note on how the works will be executed in line with the Plan de Sécurité et de Santé, separate price calculation for safety measures and PPE, and the specific safety form), and information on annual leave and compensatory rest days.

Technical product sheets must be prepared for each product for reception technique, including DoP and CE documentation where applicable.

Signature is via a qualified electronic signature on the dépôt report.

Such as for minimum qualification requirements, bidders are subject to exclusion grounds under Belgian law (motifs obligatoires et facultatifs) and must have no significant social or fiscal debts (≤ 3,000 € or covered by exemptions).

For selection qualitative, contractors must demonstrate “agréation d’entrepreneur” under the law of 20 March 1991 in category C, with a class that will at least be around class 6 and finally determined by the amount of the approved offer.

Belgian agréés are checked via the SPF Economie database; foreign operators must give a web address or documents proving equivalent official listing or certification.

Non-agréés must supply evidence that they meet the agréation conditions of article 4 §1 of that law.

There is also an obligation to reach and prove a chosen CO₂ performance level (Échelle de Performance CO₂) via an accredited certification body, either at company or project level, with detailed substantive criteria per level 1–5.

Such as concerns the scope of the contract and execution, the object is the construction of new noise barriers near Dison on an autoroute, including preparatory works, demolitions, signalisation, topographic operations, detailed and execution plans, and as-built plans.

Show all 28 statements

The place of performance is the autoroute sector at Dison; materials from demolitions are to be deposited at the Battice autoroute district.

The contract is split into two phases: a 90-calendar-day preparation phase (which must end at least 15 days before the start of works) and a 140-working-day execution phase subdivided into three steps of 40 + 60 + 40 working days, with possible redistribution as long as the total of 140 working days is not exceeded.

The contractor must also install and maintain a site office/pavillon for the client’s supervision staff.

Such as for award criteria and their weighting, the economically most advantageous tender is determined on the basis of the best quality–price ratio with two criteria: (i) Price, evaluated on the basis of the prices of evaluation (prices of inscription minus any fictive CO₂-related reduction); and (ii) CO₂ ambition level, translated into a fictive price reduction.

The bidder may select one CO₂ ambition level: “Non” (0 %) or levels 1–5 with corresponding fictive discounts (2 %, 4 %, 6 %, 6 %, 6 %).

To reach higher levels, all lower-level criteria must also be met.

The declared CO₂ ambition (specified in annex 5 of the offer) must be achieved at the latest one year after contract conclusion or by provisional acceptance if that occurs earlier; in multi-year contracts, proof must be provided annually.

Failure to prove the ambition level leads to specific penalties linked to the fictive discount.

Such as for risks and special conditions, the bidder is bound by its offer for 180 calendar days.

Subcontracting must be declared in annex 3 with the share and identity of subcontractors; the contract includes a strict electronic registration of presences on site (ONSS/AR 11/02/2014) and an obligation to notify the chosen registration method.

A “tous risques chantier” insurance must be taken out by the contractor, covering collapse, civil liability, third-party damage, conception/calculation/execution errors, theft/vandalism, and defective materials, with all stakeholders insured and the contracting authority as indemnification beneficiary; proof of paid premiums must be available, and insurance costs are an enterprise charge.

A main guarantee (cautionnement) of 5 % of the initial contract amount and an additional 10 % guarantee on specified items subject to a posteriori technical reception are required, in favour of SOFICO; justification of constitution is sent to the named SPW Director.

The contractor bears all general site organisation costs, signalisation, topography, insurance, studies, scaffolding/access, and extra costs for night/weekend/holiday work unless these result from unforeseen decisions of the authority.

There are detailed special penalties: such as 10 €/minute for unauthorized lane closures or delayed remediation of signalisation, 1,000 € per breach of general site signalisation/deviation organisation, penalties for failing to inform the PEREX centre of changes, and CO₂ ambition penalties equal to 1.5 times the unrealized fictive reduction, prorated per evaluation moment and shortfall percentage.

Plans by the authority are indicative principles and may be adapted on site without price unit changes; the administration reserves the right to significantly change enterprise limits and dimensional characteristics, and the contractor cannot invoke lack of data to escape responsibility.

For disputes about attribution, the annex explains the recourse paths before the Conseil d’État (annulation, suspension in extrême urgence) and the non-binding mediation by the Médiateur; here, the legal texts cited (loi du 17 juin 2013, LCCE, AR 19/11/2024) define which rules apply, and in case of conflict the Belgian legal framework governs, with courts of Liège competent for contractual disputes.

Tactics

When contracts were awarded in this country and sector, usually about 4 bids came in. A normal field for this market. (Based on 1,540 completed awards — not a statement about this procedure.)

This procedure allows 59 days between publication and deadline — typical in this country is 34 (median of 3,233 procedures). Much more generous than usual — time for a thorough bid rather than a quick one.

Foreign bidders

In Belgium · Construction work, 237 contracts went to foreign companies over the last 3 years (of 2,628 recorded awards) — mostly from France, Germany, Netherlands.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
