What the buyer is looking for
The service for supporting the functional capacity and inclusion of working-age people is a goal-oriented service package in accordance with the Social Welfare Act, the purpose of which is to strengthen a person's independent coping, social interaction and opportunities to participate in society's activities. The service is intended for people with disabilities and barriers to inclusion who are unable to participate in other public employment services. The functional capacity has been reduced due to an injury, illness or other life situation in a way that prevents equal inclusion. The tenderer must provide the customer with a work place including suitable work tasks, necessary guidance and equipment, and safe workspaces. The proposed legislation (HE180/2026 vp, detailed justification for section 17 of the Social Welfare Act) would not link the possibility to produce work activities for…

… the wellbeing services county to the legal form of the service provider. Instead, the same objective would be achieved by laying down the framework conditions for carrying out work activities. The decisive factor in the assessment would therefore not be whether the wellbeing services county, association, foundation or company produces the work activity, but whether the work activity is used to replace work or a service that would otherwise be carried out for consideration. (See service description) The service for support for functional capacity and inclusion is based on section 17 of the Social Welfare Act and the Government proposal HE 180/2026 vp for an Act amending the Social Welfare Act and related acts. According to current estimates, the Act is expected to enter into force on 1 January 2027. If the content of the Act, the date of entry into force of the Act or any other event materially affecting the performance of the procurement changes during the procurement procedure or before the beginning of the contract period, the Subscriber has the right to suspend the procurement procedure, amend the procurement documents to the extent permitted by the procurement legislation, or make any other solution required by the situation. Contracts are drawn up and signed after the law has been adopted.
