Overview of procurement and contract conditions for dental materials and devices
This text is an extract from the procurement documents of the Lithuanian University of Health Sciences Hospital Kauno Klinikos and from the general and special conditions of the standard ‘Contract for the Sale of Goods’, which applies to the purchase of dental materials and supplies.
All material is based on the provisions of the Law on Public Procurement of the Republic of Lithuania (Law on Public Procurement of the Republic of Lithuania) and other legal acts of Lithuania, so the perspective is clearly in Lithuanian, both in terms of procurement procedures, contract performance and dispute resolution.
The proposal must include: the completed tender form (Annex 1), the European Single Procurement Document (ESPD) in accordance with Annex 3, the joint deployment contract (if applicable), the power of attorney to sign the tender (if applicable), the documents concerning reliance on the resources of other economic operators (if applicable), and the documents referred to in the technical specification (including the manufacturer’s booklets to justify the parameters).
The conformity of exclusion grounds and qualifications shall be declared in the ESPD and certificates shall normally only be required from the most economically advantageous tender, but the contracting authority may request evidence at any stage.
The possibility of participating in a group of economic operators, relying on the capacities of other economic operators (e.g. joint ventures, subcontracting) is also provided for, provided that the availability of resources during the performance of the contract is proven by means of contracts and that liability for financial capacities can be held jointly and severally liable.
As regards the scope and subject-matter of the contract, it is specified that the subject-matter of the contract is dental materials and devices purchased as a green purchase pursuant to Order No D1-508 of the Minister for the Environment (subparagraph 4.4.4).
The procurement shall be divided into 5 lots; a tenderer may submit a tender for one, several or all of the lots, each lot being awarded a separate contract or a single framework contract for a single supplier.
Place of delivery – Kaunas Clinics, Eivenių str. 2, Kaunas; Orders are placed by e-mail, are considered to have been received the next business day, and the supplier must deliver the goods within 3 weeks of the order, after agreeing on the exact time and place.
The duration of the contract is until full performance (until the quantities/value are exhausted) or termination, but not longer than 24 months, with the possibility of one further extension up to 12 months without increasing the price if the amount or quantities have not been redeemed.
As regards the evaluation and award criteria, the text makes it clear that the most economically advantageous tender is selected solely on the basis of the price, with the lowest price winning and, where several prices are equal, the tender submitted by the CVP IS at the earliest.
No electronic auction is foreseen.
The Commission shall first check compliance with the formal requirements, the ESPD information, the conformity of the price with the funds available for the purchase, and subsequently the conformity of the technical specification and, where appropriate, samples of the supplies.

The ranking of tenders and the award decision shall be notified within 3 working days and the contract shall be signed in accordance with the standstill period of 5 working days.
In terms of risks and special conditions, many aspects relevant to the supplier are identified, such as: penalties, guarantees, use of subcontractors, tender and contract validity issues, environmental criteria.
In such cases, the contract may be unilaterally terminated and a penalty of 30 % of the initial contract value shall apply.
The guarantee of the performance of the contract by a bank guarantee/insurance guarantee (if required by the buyer in the Special Conditions) is also provided for, as well as the guarantee of an advance, although no advance is provided for in the specific purchase.
Subcontractors may be used, but their replacement or use of new ones, where their capacity has been used for qualification, shall require the written consent of the buyer; the buyer may also make direct payments to sub-suppliers through tripartite contracts.
The documents also regulate in detail environmental and organisational risks and procedures.
For example, as a green purchase, an environmental criterion is established that the Supplier must deliver the goods outside peak hours (Monday to Friday 9:30-15:30) and on the shortest route, while infringements are subject to a fine of EUR 50 per case.
During the performance of the contract, the supplier must provide instructions for use, certificates, CE marking documents (at the request of the buyer), the supplier is responsible for the accuracy of the translations.
Explanations of tenders and all communications are carried out only by the CVP IS, no meetings on clarification of terms and conditions are foreseen, and the buyer can revise the documents before the deadline for tenders, ensuring the anonymity of suppliers.
As regards possible contradictions or corrections, the documents contain a clear rule on the primacy of documents: the technical specification, followed by the special conditions, hereinafter referred to as ‘general conditions’, the procurement documents (with the exception of the specification), the supplier’s tender and other annexes.
Thus, if, for example, the general conditions and the special conditions set a certain time limit or requirement differently, the special condition applies. if a special condition conflicts with a technical specification, the technical specification takes precedence, and in the case of any conflict with the PSO, the law takes precedence.
Furthermore, the procurement conditions expressly provide that the contracting authority may amend or revise the procurement documents, if necessary by extending the time limit for the submission of tenders, and may, in the event of doubt as to the confidentiality of the information provided by the suppliers, require a justification and, in the absence thereof, consider the information to be no longer confidential.
Only the contracting authority's tender documents are binding. As of: 28/10/2026
