Operatorul economic trebuie sa dovedeasca faptul ca este legal constiuit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatiile care fac obiectul contractului. Obiectul contractului trebuie sa aiba corespondent in codul CAEN autorizat conform Legii 359/2004. Ofertantii, eventual subcontractanti/asociatii / terti sustinatori vor completa la nivelul DUAE, informatiile aferente situatiei lor. Documentele justificative urmeaza a fi prezentate la solicitarea autoritatii contractante, doar de ofertantul clasat pe primul loc (inclusiv pentru subcontractanti/asociatii / terti sustinatori) la finalizarea evaluarii ofertelor. In cazul in care un operator economic isi demonstreaza capacitatea tehnica si/sau profesionala invocand si sustinerea acordata, in conformitatea cu prevederile Legii 98/2016 de catre unul sau mai multi terti, atunci operatorul economic are obligatia de a dovedi autoritatii contractante ca a luat toate masurile necesare pentru a avea acces in orice moment la resursele necesare, prezent intr-un angajament in acest sens din partea tertului/tertilor. odata cu angajamentul de sustinere, ofertantul/canditatul are obligatia sa prezinte documente transmise acestuia de catre tertul/tertii sustinatori/sustinatorii, din care sa rezulte modul de indeplinire.
