Operatorii economici (ofertant, tert sustinator) ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Inițial se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative: - Certificat constatator eliberat de Oficiul Registrului Comertului, sau in cazul ofertantilor straini, - Documente echivalente emise in tara de rezidenta. Informatiile cuprinse in documentele justificative trebuie sa fie reale/valide la data prezentarii acestora. Ofertantul are obligația să facă dovada că în ultimii in ultimii 3 ani, raportat la data limita de depunere a ofertelor in prezenta procedura, a furnizat produse similare in valoare de cel putin 839002 lei si va completa DUAE, la nivelul unuia sau maxim 3 contracte. Ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalul evaluarii ofertelor, va depune la solicitatrea autoritatii contractante, documente care sa dovedeasca cele declarate, respectiv contracte, procese verbale de receptie, documente constatatoare etc, din care sa reiasa data, valorile, denumirea produselor, indiferent daca livrarile s-au facut catre clienti persoane juridice de drept public sau privat. Initial, se va complete DUAE. Ofertantul clasat pe primul loc in clasamentul intermediar va depune la solicitarea autoritatii contractante, documente ce dovedesc experienta similara (contracte, receptii etc), atat in relatia cu clienti autoritati contratante cat si clienti privati.
