… contracting authority for technical or other parameters of the required performance of individual parts of the public contract are specified in the relevant annexes No. 2 to these tender specifications. Where references are made in the procurement documents to particular suppliers or products, or to patents relating to inventions, utility models, designs, trade marks or designations of origin, this shall be done in the interests of the accuracy and comprehensibility of the specifications. In the case of the use of such references, the contracting authority, in accordance with Section 89(6) of the ZZVZ, accepts an equivalent solution that meets the contracting authority’s requirement, in particular as regards the performance and function of such an alternative.
