Участникът следва да притежава валиден лиценз за извършване на частна охранителна дейност по чл.5, ал.1, т.2 от Закона за частната охранителна дейност (ЗЧОД) или удостоверение издадено по реда на наредбата по чл.2, ал.4 от ЗЧОД, с обхват територията на цялата страна или територията на област Сливен. Когато участник в процедурата е чуждестранно лице, същият следва да притежава еквивалентен документ, съгласно законодателството на държавата, в която участникът е установен. Когато за изпълнение на услугата, съгласно законодателството на държавата, в която участникът е установен, е необходимо специално разрешение или членство в определена организация, участникът следва да докаже наличието на такова разрешение или членство. При подаване на офертата, за доказване на съответствието си с изискването за годност, Участникът следва да посочи необходимата информация в Част IV „Критерии за подбор", раздел А: „Годност“ от ЕЕДОП. Документите за доказване на съответствие с критериите за подбор, съгласно чл.67, ал.5 и чл.112 от ЗОП – заверено от участника копие на валиден лиценз за извършване на частна охранителна дейност по чл.5, ал.1, т. 2 от Закона за частната охранителна дейност (ЗЧОД) или на удостоверение издадено по реда на наредбата по чл.2, ал.4 от ЗЧОД, с обхват територията на цялата страна или територията на област Сливен, чрез което се доказва съответствието му с поставените от Възложителя изисквания за годност за упражняване на професионална дейност. В случай, че избраният за изпълнител е чуждестранно лице, на основание чл. 112, ал. 1, т. 4 от ЗОП при сключването на договор, той следва да представи документ, с който да докаже, че има право да изпълнява услугите, предмет на поръчката в Република България, вкл. че е получил съответното разрешение или е извършил съответната регистрация, когато е необходимо. В случай на участие на обединение, което не е юридическо лице спазването на изискването се доказва съгласно разпоредбата на чл.59, ал.6 от ЗОП. При участие на подизпълнители, същите следва да отговарят на горепосоченото изискване съобразно вида и дела от поръчката, който ще изпълняват.
