Clement What the numbers say about this buyer

  • In this sector the buyer awards roughly every 3 months (7 awards, most recently September 2026) — the next award is due around January 2027 by that rhythm. The last award went to IMP, d.d., družba za svetovanje, projektiranje, inženiring in gradnjo.n = 7
  • 24% of this buyer's awards went to companies that had already won here before (948 awards since 2017, spread over 265 companies). That is well below the sector norm (38%) — this buyer switches suppliers more often than others.n = 948 awards since 2017
  • The median procedure drew 2 bids (882 procedures with a bid count); 50% ended with a single bidder. Sector: median 3 bids.n = 882
  • The award came in at a median 89% of the estimated value (151 awards with both estimate and value) — pricing at the estimate is usually too high here. Sector: 81%.n = 151
  • 11% of awards went to companies from abroad (948 awards with a known winner country). Sector average: 6%.n = 948

Tender documents at a glance

The essentials of the tender documents, read in seconds. For your bid, the original documents count.

The input text concerns a Slovenian public procurement procedure conducted by DARS d.d. (Družba za avtoceste v Republiki Sloveniji) for the supply of “drobni material” (small material – bolts/screws and machine tools). The legal framework and point of view are those of the Republic of Slovenia and EU law (ZJN-3, EU sanctions against Russia, GDPR, etc.). The documentation defines the scope (successive supplies of bolts and tools), technical standards, contractual terms, financial guarantees, and the full set of forms and declarations that bidders must submit via the Slovenian e-procurement system e-JN.

As background, the documentation is structured into several chapters: Chapter 1 “Navodila ponudnikom” (Instructions to tenderers), Chapter 2 technical specifications plus the Excel “Ponudbeni predračun”, Chapter 3 offer form and bid bond template, Chapter 4 draft contract, Chapter 5 template for performance guarantee, and Chapter 6 capability and declaration forms, plus the ESPD form. There are also provisions for later “Pojasnila” (clarifications) and “Dodatki” (addenda), which automatically become part of the tender documents. The contract is an open procedure with electronic submission, a fixed offer validity, and extensive rules on confidentiality, subcontracting, financial security and anti‑corruption.

Show the full summary (7 paragraphs)

Regarding what the bidder must submit and minimum qualification, the text specifies that every economic operator (and each partner/subcontractor where relevant) must submit a completed ESPD form as primary proof of: no exclusion grounds under ZJN‑3 art. 75 (such as criminal convictions, tax and social contribution debts, labour-law breaches, insolvency, past serious deficiencies with DARS, etc.), compliance with EU sanctions against Russia (special “Izjava 5.1(g)” in Chapter 6), and fulfillment of participation criteria (registration for the relevant activity and financial soundness, including no bank account block longer than 15 days in the last 6 months). In addition, bidders must submit all Chapter 6 forms: statements on ownership structure, the “IZJAVA 1” on absence of conflicts of interest/market distortion, data for contract entry, plus “PODATKI O PODIZVAJALCU” for each subcontractor and, where the subcontractor requests direct payment, its written “zahteva in soglasje” for direct payment. In the e-offer the bidder must upload: (a) ESPD in the prescribed e-JN formats, (b) completed and signed Excel bill of quantities and its PDF version, (c) completed and signed Chapter 3 Offer Form, (d) a bid bond in the amount of 5,400 EUR valid at least until 30.4.2027 (content per Chapter 3 template, with qualified e-signature if digital), (e) powers of attorney for the lead partner in case of a joint bid. All documents must be in Slovenian; foreign bidders must ensure correct translation and appoint a contact person in Slovenia.

Concerning the scope of the contract (what, how much, where, when), the subject is successive supplies of small material (bolts and machine tools) over a period of 36 months, under a framework-type supply contract. Quantities in the offer’s Excel bill of quantities are described as indicative; DARS will order only types and quantities it actually needs, and is not obliged to draw the full quantities, but the overall contractual value (net + 22 % VAT) may not be exceeded. The technical specifications require that, for example, bolts must comply with standards such as SIST EN ISO 898-1 and relevant ISO/DIN standards (ISO 4017 bolts, ISO 4032 nuts, ISO 7040 lock nuts, ISO 7093 washers, ISO 7980 spring washers, DIN 6798A toothed washer), quality class 10.9 and appropriate corrosion protection (typically galvanised). Deliveries take place on DARS locations indicated in each “odpoklic” (call-off), usually between 7:00 and 14:00; the maximum deadline for each delivery is normally 7 working days from call-off (15 days for certain goods per contract text), and the contractor must ensure suitable, eco-friendly packaging and, when requested, take back waste packaging. The contract duration is 36 months from signing; the guarantee for due performance must be valid at least 30 days beyond the contractual term.

As to award criteria and weighting, the documentation is very clear: the sole award criterion is the economically most advantageous tender defined as the lowest price in EUR excluding VAT. There are no qualitative subcriteria. All admissible bids are ranked exclusively by total price; in the case of a tie (two or more admissible bids with identical lowest price), the contracting authority will select the contractor by drawing lots. Such drawing is carried out at DARS’s premises, bidders concerned are invited and allowed to attend, and the authority prepares and delivers a record of the drawing to all tied bidders.

On risks and special conditions, the documents establish several critical obligations and penalties. There is a bid bond (garancija za resnost ponudbe) of 5,400 EUR, callable if the bidder withdraws its bid during its validity, fails to sign the contract within 8 days of receipt, or fails to provide the performance guarantee. The selected supplier must, within 10 working days of receiving the signed contract, provide a performance guarantee (garancija za dobro izvedbo) equal to 10 % of the contract value incl. VAT, issued by a bank or insurer in Slovenia and valid at least 30 days beyond contract expiry. Failure to submit this guarantee means the contract is deemed never to have been concluded, DARS will cash the bid bond, and may exclude the supplier from further public procurement procedures for three years as a “precejšnja pomanjkljivost”. There are contractual penalties: 50 EUR per day of delay in deliveries, a 1,000 EUR penalty for any change of responsible persons or subcontractors without prior consent, and a global cap for contractual penalties of 10 % of the contract value (without prejudice to full damages if actual loss exceeds penalties). In addition, there is a very strict confidentiality clause: the supplier must have internal rules on business secrets, get employees to sign confidentiality statements, sign a separate Confidentiality Agreement, and may be charged a contractual penalty of 20,000 EUR per each breach of confidentiality plus full damages and lost profit. The offer validity is fixed until 31.3.2027; the contracting authority may ask for extension of bid and bond validity, which the bidder may refuse (but then its bid is excluded after expiry). Questions/requests for clarification must be submitted via the national tender portal by the deadline specified in the notice; all clarifications and addenda become integral parts of the tender. No variant bids are allowed, and there is no site visit foreseen.

Regarding contradictions or corrections within the documents, the text itself sets a clear hierarchy and conflict-resolution rules. Such as: Chapter 4 (contract template) explicitly lists the constituent parts of the contract in descending order of precedence: 1) the signed contract, 2) technical specifications with annexes, 3) tender documentation (complete RFQ), 4) the contractor’s tender, 5) subcontractors’ direct-payment consents, and 6) the joint execution legal act in case of a joint bid. Moreover, for possible discrepancies between the Offer Form (uploaded under “Predračun” in e-JN) and the detailed Excel/PDF bill of quantities (uploaded under “Drugi dokumenti”), the instructions state that the data in the signed PDF version of the offer bill of quantities are considered binding. Changes to the tender documentation can only be made through formal addenda published on the portal, which then prevail over the initial texts. No internal contradictions of substance (e.g. different award criteria or different guarantee levels) are evident in the cited passages; where there is potential overlap (e.g. delivery times mentioned both in technical specifications and draft contract), the wording is consistent or supplemented, and the conflict-resolution clause in the contract would govern if any discrepancy arises.
