… the functioning of the management team and the implementation team. · The procurement is carried out within the project “Strengthening the administrative capacity of the National Research Authority to ensure that the criteria related to the enabling condition “Good governance of the national or regional smart specialisation strategy” are maintained”, SMIS code 364705. In accordance with the above-mentioned legal regulations, the NCA will carry out the evaluation of SNCISI and PNCDI IV with independent expertise, contracted following the public procurement/auction procedures, in accordance with the provisions of Law No 98/2016, as subsequently amended and supplemented.

Operatorii economici care depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta din care sa rezulte ca operatorul economic este legal constituit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului/acord-cadru. Ofertantul unic / Ofertantul asociat /Subcontractantul vor completa DUAE - sectiunea "Criteriile de selectie" - pct. A "Capacitatea de a corespunde cerintelor". Ofertantul clasat pe primul loc dupa aplicarea criteriului de atribuire va prezenta, anterior atribuirii contractului/acord-cadru, la solicitarea Autoritatii Contracte, Certificatul Constatator emis de Oficiul Registrului Comertului de pe langa Tribunalul Teritorial in integralitate, din care sa rezulte ca activitatea principal / secundara pe care o desfasoara conform codificarii CAEN corespunde obiectului contractului. De asemenea, in Certificatul Constatator emis de Oficiul Registrului Comertului de pe langa Tribunalul Teritorial trebuie sa se regaseasca si urmatoarele informatii: datele de identificare ale operatorului economic, actionarii/ asociatii, organele de conducere, administratorii, membrii Consiliului de Administratie, membrii Consiliului de Supraveghere, cotele de participare. Nota 1: Toate documentele justificative care atesta capacitatea de exercitare a activitatii profesionale a operatorilor economici vor contine informatii reale, valabile si actuale la data prezentarii acestora. Nota 2: Pentru operatorii economici străini se vor prezenta documente echivalente emise de autoritățile competente din țara de rezidență, însoțite de traducerea autorizată în limba română. Dacă în țara de rezidență nu se emit asemenea documente sau acestea nu acoperă toate situațiile prevăzute la art. 164, art. 165 și art. 167 din Legea nr. 98/2016, se poate prezenta o declarație pe propria răspundere sau, dacă legislația statului respectiv nu reglementează o asemenea declarație, o declarație autentică dată în fața unui notar, a unei autorități administrative ori judiciare sau a unei asociații profesionale competente. Nota 3: In cazul unei asocieri, se vor prezenta documente care atesta forma de inregistrare pentru fiecare dintre membrii asocierii. Pentru indeplinirea cerintei este suficient ca obiectul de activitate al fiecarui membru sa fie in concordanta cu partea din contract pe care o va realiza. Nota 4: In situatia in care Ofertantul subcontracteaza parti din contract, acesta va prezenta documentele care atesta forma de inregistrare pentru Subcontractantii declarati in DUAE. Nota 5: Pentru subcontractantii declarati in DUAE, obiectul de activitate inscris in documentele care atesta capacitatea de exercitare a activitatii profesionale va fi in concordanta cu partea din contract pe care acestia o vor realiza. Nota 6: Din documentele prezentate trebuie sa reiasa informatii valabile/reale la momentul prezentarii. Nota 7: Autoritatea contractanta poate solicita ofertantilor sa completeze sau sa clarifice documentele justificative prezentate ca dovada a informatiilor cuprinse in DUAE.
