Some of these measures involve excavated material, which can no longer be reused on site (e.g. displacement due to stronger bonded construction, due to its soil mechanical properties, etc.). … classification classes (Z 0 2) in accordance with the guidelines for backfilling pits, fractures and opencast mines (LVGBT, status: July 2021) or partly also in landfill classes according to the Landfill Ordinance (DepV). Due to technically inseparable admixtures on old road surface residues, in individual cases the material can be classified as hazardous waste (AVV 170503*) after hot spot sampling. The subject of this invitation to tender is an interim storage of approximately 9,000 tonnes of excavated material from construction sites within the urban area to be carried out by the contractor on an interim storage area approved and managed for hazardous waste (including AVV 170503*) for declaration purposes, as well as proper and harmless disposal to be carried out by the contractor (e.g. recovery as backfilling or landfill replacement building material, thermal recovery, recycling, etc.) in facilities approved for this purpose. For this purpose, the contractor shall, in accordance with § 22 KrWG, fulfil the obligations of the waste producer (here: the client). The customer's liability under waste law remains unaffected by this. -- Based on the experience gained in recent years, a quantity of approximately 9,000 tonnes of excavated materials from various civil engineering works of the Department of Civil Engineering is expected for this framework agreement during the tendered period. The tendered quantities of individual services are based on the experience of recent years, estimates from contaminated site investigations and the currently available knowledge of planned construction measures. They are therefore burdened with uncertainties, so that the quantity of a service actually called up can also deviate significantly from the quantities put out to tender. A minimum acceptance rate of 70% of the total amount of the tender shall be fixed for this framework agreement. The maximum limit up to which the contracting authority may make an individual call is 140% of the total amount of the tender.
