Operatorii economici ce depun oferta trebuie sa detina atestare ori apartenenta din punct de vedere profesional, respectiv sa detina Aviz de functionare emis de Ministerul Sanatatii privind activitatile de comercializare pentru produsele ofertate conform art. 927 din Legea nr. 95/2006 privind reforma in sanatate, precum si pentru activitatea de service, care sa cuprinda producatorii produselor ofertate pentru care firma este inregistrata ca distribuitor. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: Completare DUAE de catre toti operatorii economici participanti la procedura de atribuire, urmand ca documentul justificativ, respectiv avizul emis de Ministerul Sănătății sau pentru ofertantii straini, documente echivalente emise in tara de rezidenta, sa fie prezentate numai de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
