… completely new DWDM equipment (including for existing resources for which replacement is not necessary) or when necessary to modify all existing applications and systems using these resources, the contracting authority considers that In the present case, the contracting authority does not proceed with the division of the public contract into lots, since the subject of the public contract forms a single functional unit and is awarded in a temporal context. When awarding the public contract, the contracting authority is in the position of a provider of a regulated service, subject to higher obligations within the meaning of Act No. 264/2025 Coll., on Cybersecurity, as amended, and its implementing regulations, whereby this fact is taken into account by the contracting authority in the tender specifications for this public contract.
