… operator to perform the tasks as specified in the Client’s ad hoc orders. The contracting authority shall specify indicative quantities in order to ensure the comparability of tenders. The planned number of operating hours for weeding, beetle and mulching as a case-by-case requirement is 8500 operating hours. The expected total contract period for the processions to the work site specified by the Customer is 150 times, and the passage distance between the work areas is expected to be 2500 km. The successful tenderer is obliged to know the railway and official regulations related to the work, the construction technology and to fully comply with them during the work. The successful tenderer is obliged to document the performance of these tasks on the basis of the instructions and regulations in force and to hand over the documentation to the representative of the Contracting Authority. Further details and conditions are set out in the Public Procurement Documents. In this call for tenders and in the procurement documents, the contracting authority provided the quantitative data for information purposes, and after the conclusion of the framework contract, the quantity of services actually ordered may differ from these expected quantities. At the same time, the Contracting Authority draws the attention of T. Tenderers to the fact that the data specified as the expected quantity serve the purpose of comparability of tenders and form the basis of the financial means available by the Contracting Authority for the performance of the contract. In view of this, if, in the most favourable offer, the bid price calculated on the basis of the individual unit prices offered by the Tenderer (operating hour fee net HUF/hour, or procession and transit fee HUF/km) and the expected quantities exceeds the bid price determined by the Contracting Authority during the preparation of the procedure (and the Public Procurement Act). In accordance with Section 75(4) of the Public Procurement Act, the contracting authority may justify the extent of the financial resources, and the procedure shall be governed by the Public Procurement Act. In the light of Section 75(2)(b), it may declare it ineffective. The Contracting Authority draws the attention of the Tenderers to the fact that where the technical specifications refer to a product of a specific make or origin or to a specific process that characterises the products or services provided by a given economic operator, or to a trademark, patent, activity, person, type or a specific origin or production process, as well as to a standard, technical approval, technical specifications, technical recommendations, the designation has been made only in order to clearly define the nature of the object, and the term ‘or equivalent’ must be understood in addition to the designation.
