Public works tender for modular skylights (‘verrières’) – Dalheim school project (Luxembourg)

The input text concerns a Luxembourg public works tender based on CRTI‑B standard contractual clauses for the construction project “Neubau Grundschule / bâtiment scolaire à Dalheim” (Grand Duchy of Luxembourg).

It consists of general contractual clauses and “clauses contractuelles particulières” for a specific lot covering planning, fabrication and installation of modular and shed‑type rooflights (verrières) for a school building and gym.

The perspective is that of a Luxembourg contracting authority applying the Luxembourg Law of 8 April 2018 on public procurement and its Grand‑Ducal implementing regulations.

As background, the tender is governed by the Law of 8 April 2018 on public procurement and the Règlement grand‑ducal (RGD) of 8 April 2018, as well as the RGD of 24 March 2014 on standard specifications, all explicitly referenced.

The contract documents are hierarchised (such as: 1) bordereau des prix, 2) plans de soumission, 3) clauses contractuelles particulières, 4) clauses techniques particulières, 5) clauses techniques générales, 6) clauses contractuelles générales).

Regarding what the bidder must submit and the minimum qualification requirements, the general clauses require (such as) a European Single Procurement Document (DUME), an extract from the criminal record (probity of the signatory), proof of registration in a professional/commercial register, the last three certified annual accounts and profit‑and‑loss statements, information on staff and key personnel qualifications, and a list of works executed in the last five years supported by certificates of good execution.

Tax and social security compliance certificates must be provided on request within at least 15 days, including equivalent certificates from the bidder’s home country if outside Luxembourg.

The particular clauses add minimum participation conditions: a minimum staff of 50 people in the relevant trade, and at least 5 references for similar works of the same nature, each supported by certificates of good execution; a minimum turnover is provided as an optional (not filled‑in) requirement.

For subcontractors, the same qualitative documents (e.g. on capacity and references) are required where explicitly stated.

The scope of the contract is defined in the particular clauses as planning, fabrication and installation of modular and shed‑type rooflights for a school building, with works taking place while neighbouring school buildings and a “maison relais” remain in normal operation.

The bidder must take into account constraints such as strict limitation of nuisance (noise, dust, etc.), exclusive use of defined site access (construction access from the N13 only), prohibition of fixing temporary installations to exposed structural elements in wood, masonry or concrete, and the obligation to protect all such structures from damage.

The contract is for unit prices (“prix unitaires”) and the bordereau covers fully finished works, including all ancillary costs (such as labour overheads, site installation, connections from available points, coordination with neighbouring lots, interruptions and access constraints).

The maximum execution and mobilisation period imposed by the project management is 115 working days from the order to start works (excluding finishing, other‑trade‑dependent tasks and force‑majeure stoppages); the contractor must indicate a global period in working days in the offer which may not exceed this maximum.

Work may be intermittent to suit overall site progress, and the contractor must coordinate with other trades (e.g. floors, joinery, technical lots).

No alternative weighting or non‑price award criteria are filled in in the particular clauses (they are marked “Néant”), and the contracting authority does not foresee variants or alternative technical solutions (variants expressly excluded in the general clauses).

The mode of price offer is “prix unitaires” (unit prices).

No indemnity is foreseen for offer preparation.

Risks and special conditions are extensive.

Price revision is foreseen based on the RGD Chapter XIV, with separate indices for labour and materials and formulas detailed in the particular clauses; revisions apply throughout the contractual period.

Each payment request must include approved measurements, an approved pro‑forma invoice and a detailed progress statement, failing which it will be rejected as non‑receivable.

No advances are foreseen.

As to guarantees and insurance, the operator must hold civil liability insurance with specified minimum limits (5,000,000 EUR bodily injury; 2,500,000 EUR material and consequential damage; max. 2,500 EUR deductible) and maintain coverage throughout construction, with non‑cancellable policies.

A “tous risques chantier” policy is explicitly marked “Néant” (no requirement), but a decennial guarantee applies, with the operator obliged to submit all technical data and certificates to the control bureau; only materials and techniques approved by the control bureau can be accepted.

Subcontracting is restricted: if there is an association, the lead firm and each partner may only subcontract up to 15% of its part of the contract; the list of subcontractors must be provided with the offer and maintained throughout, with changes requiring approval.

Concerning contradictions or corrections between documents, the general hierarchy rule (bordereau > plans > particular clauses > technical particular > technical general > contractual general) governs in case of conflict.

Where specific requirements conflict with general clauses, they should normally be expressed as separate items in the bill of quantities (bordereau), which then take precedence.

Likewise, general clauses allow the authority to either install a common site signboard or not; here, the general clause has the common board option ticked, while the particular clauses add that individual advertising panels of companies are prohibited and that company spaces will be provided on the common board – the particular restriction on individual panels prevails.
