A Kr. 1. § (1) bekezdése és 5. § (1) bekezdése alapján az AT-nek az ajánlatban csatolnia kell az egységes európai közbeszerzési dokumentumot, melynek elegendő a IV. részének „α”szakaszát kitölteni e tekintetben, figyelemmel arra, hogy a Kr.2. § (5) bekezdése alapján az AK elfogadja az érintett gazdasági szereplő egyszerű nyilatkozatát is az M/1. számú műszaki-szakmai alkalmassági követelmény előzetes igazolására. Felhívjuk a figyelmet a Kbt. 62. § (1) bek. i) pontjára, és a Kbt. 73. § (1) bek. c) pontjára. A Kr. 1. §-ának (2) bekezdése alapján az AK által a Kbt. 69. § (4) -(7) bekezdése alapján az alkalmassági követelményekre vonatkozó igazolások benyújtására felhívott AT-nek a Kr. IV. Fejezetének megfelelően kell igazolnia, hogy megfelel az előírt alkalmassági követelményeknek, az alábbiak szerint: M/1.Az AT-nek a Kr. 21. § (1) bekezdés a) pontja alapján ismertetnie kell az ajánlati felhívás feladásának napját megelőző három évben - az előírásoknak és a szerződésnek megfelelően teljesített legjelentősebb adásvétel (szállítás) tárgyú referenciamunkákat a Kr. 21. § (1) bekezdésének a) pontjában és (1a) bekezdés a) pontjában, a 21 /A. §-ában, valamint a 22. § (1)-(2) bekezdéseiben foglaltak szerint. A szerződést kötő másik fél által adott igazolásnak, illetve az AT nyilatkozatának tartalmaznia kell legalább: — a szerződést teljesítő szervezet (ajánlattevő /közös ajánlattevő/a Kbt. 65. § (7) bekezdése szerinti szervezet) nevét, címét (székhelyét), — a szerződést kötő másik fél megnevezését (név és cím), — a szerződést kötő másik fél kapcsolattartójának nevét és elérhetőségét, — a szerződés tárgyának rövid leírását olyan részletességgel, melyből az alkalmassági feltételnek valómegfelelés egyértelműen megállapítható (adásvétel tárgya), — szerződéses mennyiség meghatározását/(rész)teljesítés mennyiségét (db), — a (rész)teljesítés idejét (kezdő és befejezésének időpontja év, hónap, nap megadásával), — nyilatkozatot arról, hogy a teljesítés az előírásoknak és a szerződésnek megfelelően történt-e, — konzorciumban történő teljesítés esetén információ a saját teljesítés arányáról az alkalmassági követelmények szerinti bontásban (%) Továbbá felhívjuk a figyelmet a Kr. 24. § (1) bekezdésére is. Az alkalmasság igazolása vonatkozásában alkalmazandóak továbbá a Kbt. 65. §-ának (6)-(7), (9) és (11)-(12) bekezdéseiben, a Kbt. 69. § (11a) bekezdésében, valamint a Kbt. 140. §-ának (9) bekezdésében foglaltak. Ha az előírt alkalmassági követelményeknek az AT más szervezet kapacitására támaszkodva felel meg, e szervezetnek - az általa igazolt alkalmassági követelmények tekintetében - az AT tekintetében előírt igazolási módokkal azonos módon kell igazolnia az adott alkalmassági feltételnek történő megfelelést [Kbt. 67. § (3) bekezdés]. Az alkalmasság minimumkövetelménye(i): Alkalmatlan az AT: M/1. Ha az ajánlati felhívás feladásának napját megelőző három évben (36 hónapban), a vizsgált időszak alatt befejezett, de legfeljebb hat éven (72 hónap) belül megkezdett, az előírásoknak és a szerződésnek megfelelően nem teljesített legalább 1 db olyan referenciaszállítást, amelynek tárgya az alábbi volt: legalább 179 859 kilogramm vagy 200 800 darab friss zöldség vagy gyümölcs adásvétele (szállítása). Az M/1. műszaki, illetve szakmai alkalmassági követelménynek való megfelelésre a Kbt. 65. § (6)bekezdésében foglaltak irányadók. AK a teljesítés igazolásaként a Kr. 21/A. §-a alapján elfogadja annak igazolását is, ha a referencia követelményben foglalt adásvétel /szállítás a szerződés részteljesítéseként valósult meg.
