International Public Tender 339/CPI/2026 – Acquisition of Oracle Cloud Infrastructure (OCI) Subscription Services
This input text concerns an international public tender launched by AIMA, I.P.
(Agência para a Integração, Migrações e Asilo) in Portugal for the acquisition of subscription services for Oracle Cloud Infrastructure (OCI), including associated professional services.
The country context and legal framework are clearly Portuguese: the procedure is governed by the Código dos Contratos Públicos (CCP), references the Diário da República and JOUE, and performance is in Portugal (Barcarena, Oeiras, NUT III PT1A0 – Grande Lisboa), but the tender is open internationally.
As background, the tender is a public procurement procedure for “Aquisição de subscrição de serviços OCI” with a base price of 746.400,00 EUR (without VAT) and is structured around a Programa do Procedimento, a Caderno de Encargos and annexes.
The contract type is “Aquisição de Serviços” with CPV 72415000 (web hosting services).
The contract is mainly about cloud subscription (Oracle PaaS and IaaS Universal Credits) plus a set of professional services (Project Manager, Systems Architect, Functional Consultant), and must be executed in accordance with Portuguese law, CCP and EU GDPR.
Regarding what the bidder must submit and qualification requirements, the proposal must be filed electronically on the AcinGov platform, in Portuguese, as signed PDF documents using qualified electronic signatures.
The proposal must include, such as: the Documento Europeu Único de Contratação Pública (DEUCP); a price proposal following the model in Anexo I (respecting the base unit prices in clause 6 of the Caderno de Encargos and listing credits and hours per profile); a detailed technical document describing attributes and compliance with specifications; a declaration on the technical team (Anexo II), plus non‑nominative CVs showing qualifications, certifications and experience; documentary evidence of minimum technical/certification requirements in point 3.7 of the technical annex (including PMP or PRINCE2, ITIL v4, several Oracle certifications); proof of manufacturer authorisations concerning intellectual property; commercial registry certificate or access code; and any other relevant documents (e.g. price justification).
In terms of habilitation after award, the adjudicatário must within 5 working days submit evidence of regular tax and social security status, criminal records of the company and its managers, the declaration for habilitação (per Anexo III), and Central Beneficial Owner Register information.
There is no explicit requirement for past references, turnover or specific insurance types in the Programa, but the Caderno de Encargos makes all mandatory insurances and labour‑law obligations the exclusive responsibility of the contractor.
On the scope of the contract (what, how much, where, when), the object is the acquisition of fixed and optional Oracle PaaS and IaaS Universal Credits plus specified professional services.
Show all 33 statements
Quantities and price base are defined, such as: 360.000 fixed credits (base unit price 360.000 EUR), 240.000 optional credits (base unit price 240.000 EUR), and maximum hours of 480 (Project Manager, 65 EUR/h), 640 (Systems Architect, 55 EUR/h) and 1600 (Functional Consultant, 50 EUR/h).
The contract starts at signature and, according to the Caderno de Encargos, runs until 31 December 2028 or until credits/hours are exhausted (whichever occurs first); the announcement also refers to a 24‑month execution period, which creates a potential discrepancy on duration but the Caderno de Encargos and subsequent contractual clauses prevail.
Place of performance is in Portugal, in remote or on‑site regimes, with on‑site services at AIMA’s facilities in Barcarena or other locations indicated by the contracting authority.
The technical annex further details the service scope, such as cloud architecture, security, continuity of business (DR, RPO/RTO), governance/FinOps and compliance (RGPD, ISO/IEC 27001).
Award criteria and weighting are defined as “proposta economicamente mais vantajosa” in a multi‑factor model.
The two factors are, such as: Price (P) with 40% weight, evaluated via the formula ((pb – pp) / pb) * 100 (pb = base price, pp = proposed price); and “Certificação comprovada da equipa técnica” (EQ) with 60% weight, scored up to 100 points per team member based on certifications listed in Anexo IV (e.g.
CSM, multiple Oracle cloud and database security certifications), with the final EQ factor being the average across the proposed team.
Global score PG(p) is calculated as PG = P*40% + EQ*60%; highest PG wins.
Ties are broken successively by lower price, then higher EQ score, and finally by public draw.
Proposals exceeding any base unit price or lacking required documents are excluded.
Risks and special conditions include a range of contractual mechanisms.
There is a mandatory 5% performance guarantee (caução) of the total contract value (excluding VAT), to be provided via deposit, bank guarantee or surety bond within 10 working days of adjudication, with detailed models in the annexes; execution of the guarantee can cover delays, defective performance, penalties, or other breaches, and must be replenished if partially or fully executed.
Penalties are foreseen, such as: up to 20% of the contract value in aggregate, 0.5% of the contract value per day of delay in correcting non‑conforming services, subject to CCP article 329 limits, with deduction from subsequent payments.
Subcontracting and assignment are restricted: the contractor may not subcontract or cede its contractual position without prior authorisation; the authority can reject subcontractors or cessionaries that fall under CCP article 55 impediments, and must check their habilitation documents.
The contractor must comply with strict confidentiality for five years after contract end, GDPR duties, maintain a register of all staff involved, destroy indicated records at the end of term, and is fully responsible for taxes, mandatory insurance and all damages caused.
Proposals must be maintained for 150 working days; there is no negotiation, no variants, no electronic auction, and questions/requests for clarification or error‑lists must be submitted in the first third of the proposal period via AcinGov; the jury responds by the end of the second third.
No explicit site visit obligation is mentioned.
As to contradictions or corrections, the documents establish a hierarchy and prevalence regime.
The Programa do Procedimento stipulates that its own norms prevail over any inconsistent indications in the public notice; clarifications and rectifications issued during the procedure become part of the tender documents and, in case of divergence, prevail over the original pieces.
The Caderno de Encargos sets the contract composition and precedence: adjustments formally agreed under CCP articles 99 and 101 prevail over all other documents; otherwise, in case of divergence, the order is (1) accepted error‑corrections, (2) clarifications/rectifications, (3) Caderno de Encargos, (4) awarded proposal, (5) clarifications about the awarded proposal.
Thus, where the announcement (e.g. 24‑month term, “no qualification of personnel required”) diverges from the Caderno de Encargos and Programa (e.g. term until 31.12.2028 or until exhaustion of credits/hours, minimum certifications for the team), the latter prevail by explicit clause and by CCP.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
