Clement What the numbers say about this buyer

  • In this sector the buyer awards roughly every 4 months (8 awards, most recently September 2026) — the next award is due around January 2027 by that rhythm. The last award went to Elektro-Thermit GmbH & Co. KG.n = 8
  • 54% of this buyer's awards went to companies that had already won here before (474 awards since 2025, spread over 211 companies). That is well above the sector norm (30%) — newcomers have a harder time here than elsewhere.n = 474 awards since 2025
  • The median procedure drew 2 bids (367 procedures with a bid count); 37% ended with a single bidder. Sector: median 3 bids.n = 367
  • 15% of awards went to companies from abroad (474 awards with a known winner country). Sector average: 4%.n = 474
  • The award came in at a median 76% of the estimated value (72 awards with both estimate and value) — pricing at the estimate is usually too high here.n = 72

Procurement conditions for construction goods and tools for LTG Cargo

The input text describes the procurement and contract conditions for a public purchase of “Statybinės prekės, įrankiai ir kitos veiklos užtikrinimui būtinos prekės” (construction goods, tools and other supplies) carried out by UAB „LTG Kompetencijų centras“ for AB „LTG Cargo“.

The legal framework and point of view are clearly Lithuanian: references are made to the Lithuanian Public Procurement Law (Viešųjų pirkimų įstatymas – VPĮ), the sectoral procurement law (PĮ), Lithuanian civil and tax rules, Lithuanian authorities (e.g.

VPT, Sodra, Registrų centras), and national sanctions and national security regulations.

EU law appears only as background (e.g.

The documents set out in detail what bidders must submit and what basic and exclusion requirements apply.

Such as: with the application (Paraiška) bidders must submit the completed application form (Priedas Nr. 2), the ESPD/EBVPD (Priedas Nr. II), a joint venture agreement if applying as a group, subcontractor/other economic operator declarations (Priedas Nr. III), and a general national security declaration (Priedas Nr. V).

With the offers, bidders must submit the completed offer form (Priedas Nr. 3) and its price annex in Excel (Pasiūlymo formos 1 priedas), and, where requested in the technical specification, supporting product documents.

Minimum qualification requirements beyond legal/exclusion grounds are not detailed in SPS itself: Priedas I(B) “Kiti reikalavimai tiekėjams” is expressly “Netaikoma”, so no additional financial turnover, experience references or management system certificates are required in this particular procurement.

Instead, the focus is on general competence and legal compliance, with EBVPD and later supporting documents used to prove absence of exclusion grounds, tax and social security compliance, and – when applicable – quality/environmental management and national security criteria (though those management-system requirements are not activated here).

The scope of the contract concerns ongoing supply of construction-related goods and tools.

Such as: the Special Conditions state that the supplier must deliver “Statybines prekes, įrankius ir kitas veiklos užtikrinimui būtinas prekes”, with detailed description, assortment, minimal order value, order procedures and required accompanying documents set out in the Technical Specification (Sutarties priedas Nr. 2).

The contract is structured with mixed pricing: fixed unit prices for goods listed in Annex 1A of the offer and variable prices with a percentage discount for other goods within defined product groups listed in Annex 1B.

Show all 27 statements

The initial contract value is set at 900,000 EUR (net of VAT), which equals the maximum budget for the goods.

Award criteria and weighting are defined in Priedas Nr. Y (Pasiūlymų ekonominio naudingumo vertinimo metodika).

Such as: the economically most advantageous tender is selected using two criteria – price (C) with a weight of 95, and additional warranty term in months (T) with a weight of 5. Price points are calculated as the ratio between the lowest offered price and the evaluated price multiplied by the 95% weight.

The warranty criterion is graded on a points scale depending on the number of additional months offered (0 to 5 points), then normalised to a 5% weight (Tp/Tmax * Y).

The total score S is the sum of the price and warranty scores; the highest S wins.

The SPS also confirms that evaluation follows an economic utility ranking, and that if the initially selected winner drops out or is excluded, scores are recalculated and the next highest-scoring bid can become the winner.

The documents set out extensive risks and special conditions for bidders, including penalties, guarantees, subcontracting, validity and deadlines.

Such as: although a “pasiūlymų galiojimo užtikrinimas” can generally be requested, in this concrete SPS a fixed monetary penalty is used – if the bidder invited to sign the contract refuses, it must pay a 27,000 EUR fine within 5 working days.

Contract performance is mainly secured by contractual penalties rather than a performance bond: special conditions state that obligations are ensured by netesybos (0.05% daily delay penalties for late delivery or late defect correction, plus a maximum aggregate penalties cap of 20% of the contract price), and further specific fines (e.g. for safety non-compliance, misuse of buyer’s trademarks, or breach of sanctions obligations).

Subcontracting is allowed but tightly regulated: subcontractors used to meet qualification must be named and can only be changed in restricted cases, while other subcontractors can be changed more freely but are still subject to exclusion and national security vetting, and unapproved use triggers contractual penalties.

The texts also address contradictions or corrections within the documents and clarify which statements prevail.

Such as: a clear hierarchy applies when different procurement documents conflict – the order of precedence is (1) the procurement notice, (2) answers to questions and clarifications, (3) the Technical Specification, (4) SPS and its annexes, (5) general procurement conditions (BPS), and finally (6) the contract (Special and then General Conditions).

Any clarifications or corrections issued through CVP IS become an integral part of the procurement documents and take precedence over earlier wording.

In case of discrepancies between Lithuanian and English versions, Lithuanian text prevails unless SPS states otherwise.

This hierarchy and explicit “Taikoma/Netaikoma” marking resolve potential contradictions between generic templates and the concrete SPS for this procurement.
