1. The subject of the contract is the supply of medicinal products to the UCK in the assortment, the estimated quantity and the requirements set out in Annex 3 to the ToR. 2. The Contracting Authority accepts the submission of partial tenders. The term ‘partial tender’ refers to the individual items set out in Annex 3 to the tender specification. The Contractor may submit a tender for one or more items. 3. … while maintaining the quantity required by the Ordering Party specified in the given item. The contractor must price the proposed packaging method with an appropriate conversion. 5. Deliveries will be made successively, in quantity and assortment, in accordance with the partial orders of the Ordering Party within 2 days from the date of placing the order. The Contractor will be obliged to deliver the ordered assortment at his own expense to the Hospital Pharmacy. 6. The contracting authority shall require that the prices of the medicines offered are not higher than the official prices referred to in Article 9(1)(b) CTMR. 1 and 2 of the Act of 12 May 2011 on the year of reimbursement of medicines for foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws 2025, item 907), in force on the date of submission of tenders, if any. 7. The offered medicinal products must comply with the Pharmaceutical Law of 6 September 2001 (Journal of Laws 2026, item 612), if applicable. The medicinal products offered must be authorised to be marketed in Poland in accordance with the rules laid down in Article 3 or 4a of the Pharmaceutical Law. 8. The offered medical devices must comply with the Act of 7 April 2022 on medical devices (Journal of Laws No. Journal of Laws 2024, item 1620) and in the implementing acts issued on the basis of that paragraph, if applicable. 9. In the event that the Ordering Party used in the description of the subject of the contract the indications of standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paras. 3 of the Public Procurement Act, equivalent solutions are allowed. Whenever a standard is referred to in this or the annexes to the ToR, it must be assumed that the words ‘or equivalent’ are used to refer to it. Where the description of the subject-matter of the contract refers to the standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1 point 2 and paras. 3, the contracting authority may not reject a tender on the sole ground that the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract relates, provided that the economic operator proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107, that the solutions proposed satisfy in an equivalent manner the requirements set out in the description of the subject-matter of the contract. 10. The contracting authority requires tenders to be submitted in electronic form. A detailed description (instructions) for submitting tenders in electronic form is included in paragraph XIV of the tender specification. The Contracting Authority informs that in the public procurement procedure in question the so-called Public Procurement Act will be applied. the ‘reverse order of bid evaluation’ referred to in Article 139 of the Public Procurement Act. By applying the above procedure, the contracting authority will first examine and evaluate the tenders and then make a qualitative selection of the economic operator whose tender was ranked the highest in terms of the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 14.
