What the buyer is looking for
1) The subject of the order are successive (performed in batches depending on the needs) deliveries of chemical reagents. The expected range and quantities of reagents are set out in Annex 2 to the ToR – Detailed description of the subject-matter of the contract/Assortment and price form, subject to the provisions of point 5 below. 2) The reagents offered must be brand new and from current production (i.e. produced not earlier than 12 months before the date of receipt of the subject of the order) and have an expiry date of not less than 12 months from the date of signing the acceptance protocol, except for those chemical reagents for which the manufacturer has reserved a shorter expiry date. … Republic of Poland. 3) The scope of the contract includes: the supply, transport, unloading and bringing to destination of reagents. 4) A detailed description of the subject of the contract is attached as Annex 2 to the ToR; 5) The subject of the contract, specified in Annex 2 to the ToR, was drawn up on the basis of an analysis of deliveries made over the last 24 months as part of several dozen research programmes, the continuation of which requires the absolute use of reagents from the same manufacturer. However, the analysis of deliveries carried out in previous years shows that predictability (quantitative and assortmental repeatability) is at the level of approx. 50%. Often, there is a need to change reagents during the tests. In the light of the above, the Contracting Authority reserves the right to change the quantity of the subject-matter of the contract specified as to the type (assortment) listed in Annex 2 to the tender specifications, as well as to limit the subject-matter of the contract due to needs that the Contracting Authority is not able to foresee strictly at the stage of the procedure, and under the contract, the Contracting Authority will be able to purchase reagents of the same category other than those specified in Annex 2 to the tender specifications, provided that the total value of the reagents ordered does not exceed the value of the contract, determined on the basis of the most advantageous tender accepted; 6) The basis for determining the price of reagents not included in Annex 2 to the tender specifications will be the net prices of products available in the Contractor's assortment and price catalogue (price list), determined in PLN, taking into account the discount offered on the net list prices; 7) The Contractor is obliged (in the case of the assortment not listed in the price form) to provide a link to the website of reagents (on-line) where the current assortment and price catalog (price list) of the Contractor is available, valid during the contract implementation period, and if the party so requires - also the login and password. The Contractor shall inform the Ordering Party immediately to the indicated e-mail address of any changes in the catalogue and price promotions; 8) In the case of a promotional price (special offer for reagents) - the basis for determining the price will be the promotional price (special), if it is more favorable than the list price taking into account the declared discount. Promotional (special) offers will also apply to the reagents listed in Annex 2 to the ToR; 9) The Contractor will perform the Subject of the Contract according to the current needs of the Ordering Party for a period of 24 months from the date of conclusion of the contract or until the value of the Contract is exhausted, if the contract value is exhausted before the expiry of 24 months. 10) The subject of the Agreement will be carried out in batches - on the basis of orders specifying the type and quantity of reagents within a given batch. 11) Delivery date of the ordered batch of reagents: - maximum delivery time: up to 42 days from the date of placing the order by the Ordering Party, the Contractor may shorten the delivery date in relation to the required date indicated above.
