… the maximum scope of the option right specified in that Annex is not exceeded, 2) place an order covered by the option right with the Contractor by an authorised representative of the Ordering Party referred to in § 12 sec. 1 point 2, in the manner specified in § 6 sec. 4 of the draft contract – Annex 4 to the tender specification – constitutes the exercise by the contracting authority of the right of option as regards the quantity and type of equipment indicated in the contract, 3) the contracting authority may exercise the right of option once or repeatedly, by placing successive orders covering selected quantities and types of equipment, until the maximum scope of the right of option specified in the tender form – Annex 1 to the contract is exhausted, but no later than within the time limit referred to in point 1, 4) the value of the equipment ordered under the right of option will be in accordance with the unit prices indicated by the contractor in the tender form – Annex 1 to the tender specification, 5) the deadline for the performance of each contract covered by the right of option: up to 30 days from the date of placing an option order by the Ordering Party, 6) exercising the option right does not constitute an amendment to the contract. The Contractor shall not be entitled to any claim against the Ordering Party for non-exercise by the Ordering Party of the option in whole or in part. The decision to exercise the option right, including its scope, is a unilateral right of the Contracting Authority, (7) the provisions of the draft contract – Annex 4 to the ToR concerning the basic contract apply mutatis mutandis to contracts covered by the option right, unless otherwise stipulated. 5. A detailed description of the subject-matter of the contract is set out in Annex 5 to the ToR – description of the subject-matter of the contract. 6. Place of delivery of equipment: University of Gdańsk IT Centre, ul. Prof. Maria Janion 7, 80-309 Gdańsk. 7. The customer requires a warranty on the equipment for a period of 36 months. Details of the guarantee are set out in Section 7 of the draft contract – Annex 4 to the ToR. 8. In the description of the subject-matter of the contract, which constitutes Annex 5 to the tender specification, the contracting authority described the requirements for management systems relating to the production process of the equipment offered by reference to the standards indicated in item 14 of Table 1 of the description of the subject-matter of the contract. Whenever those standards are indicated in the body of the ToR, including in the annexes to the ToR, it must be understood that such an indication is accompanied by the words ‘or equivalent’. Thus, the Contracting Authority accepts solutions equivalent to the standards indicated in item 14 of Table 1 of the description of the subject-matter of the contract, in accordance with Article 101(1) CTMR. 4 and 5 PPL Equivalence should be understood as meaning that the equipment offered comes from production covered by an implemented and up-to-date management system, which meets in an equivalent manner the requirements set out in item No 14 of Table 1 of the description of the subject-matter of the contract. The equivalent solutions used must correspond to the nature and scope of the objectives pursued by the standards referred to in item 14 of Table 1 of the description of the subject-matter of the contract. 9.
