… informs that it may cancel this procurement procedure if the public funds it intended to use to finance the entire contract or part of the contract have not been awarded to it. The Contracting Authority reserves the right to cancel the procedure pursuant to Article 257 of the Public Procurement Act if public funds intended to finance all or part of the contract are not awarded until the public procurement procedure is completed. 4. The subject of the contract must have certificates, attestations and permits for use in the activities of the Ordering Party in accordance with Polish law. The Contractor is obliged to verify the documents provided in terms of legality and compliance with the actual legal status. The subject of the contract must be brand new, equipment manufactured in 2026, unused, not subject to exhibitions, scientific research, development works, research services, not subject to sub-emonstration and reconditioning, previously not used for any purpose by another entity, authorized for marketing and use in the Republic of Poland in accordance with applicable law; complete equipment, ready for use after installation without the need for supplementary purchases.
