Участникът следва да е вписан в Централния професионален регистър на строителя (ЦПРС) към Камарата на строителите в България, съгласно чл. 3, ал. 2 от Закона за Камарата на строителите (ЗКС), за изпълнение на строежи от трета група, първа категория, а за чуждестранни лица – в аналогични регистри, съгласно законодателството на държавата членка, в която са установени. При подаване на оферта, информацията относно изискването се посочва от участника в ЕЕДОП. Съгласно чл. 67, ал. 5 от ЗОП, Възложителят може да изисква от участниците по всяко време след отварянето на офертите да представят всички или част от документите, чрез които се доказва информацията, посочена в ЕЕДОП, когато това е необходимо за законосъобразното възлагане на поръчката. Документи за доказване: Удостоверение за вписване в ЦПРС към Камарата на строителите в Република България, съгласно чл. 3, ал. 2 от ЗКС, както и валиден контролен талон, за изпълнение на строежи от трета група, първа категория, а за чуждестранни лица, в случай че не притежават регистрация в ЦПРС към Камарата на строителите в Република България – еквивалентен документ, удостоверяващ правото да изпълняват строителство по предмета на обществената поръчка, издаден от компетентен орган на държава – членка на Европейския съюз или на друга държава – страна по Споразумението за Европейското икономическо пространство, или да представят нормативния акт с посочване на съответното правно основание, по силата на което съответният участник има право да извършва строителството. При сключване на договора, определеният за изпълнител участник трябва задължително да представи заверено копие на Удостоверение за вписване в ЦПРС в трета група – строежи от първа категория и валиден контролен талон. В случай че определеният за изпълнител е чуждестранно лице, което не притежава съответната регистрация в ЦПРС, преди сключване на договора, той трябва да представи документ, с който да докаже, че има право да изпълнява възлаганата дейност в Република България, включително че е извършил съответната регистрация съгласно Закона за камарата на строителите, във връзка с разпоредбата на чл. 112, ал. 1, т. 4 от ЗОП. Документите се представят и за подизпълнителите, ако има такива и ако е приложимо за тях, съгласно чл. 66, ал. 2 от ЗОП.

Professional liability insurance

Участникът да има валидна застраховка „Професионална отговорност” за строител, съгласно чл. 171, ал. 1 от Закон за устройство на територията (ЗУТ), с минимално застрахователно покритие за изпълнение на строежи първа категория, съгласно чл. 5, ал. 2, т. 1 от Наредба за условията и реда за задължително застраховане в проектирането и строителството. За чуждестранно лице, което е установено на територията на Република България - да има еквивалентна застраховка за професионална отговорност в друга държава - членка на ЕС, или от друга държава - страна по Споразумението за Европейското икономическо пространство, съгл. чл. 171а от ЗУТ. Доказва се със заверено копие на валидна застраховка „Професионална отговорност“ по чл. 171, ал. 1 от ЗУТ за строител, с минимално застрахователно покритие за изпълнение на строежи от първа категория, съгласно чл. 5, ал. 2, т. 1 от Наредба за условията и реда за задължително застраховане в проектирането и строителството или заверено копие на валидна еквивалентна застраховка за професионална отговорност или гаранция в друга държава – членка на Европейския съюз, или от друга държава – страна по Споразумението за Европейското икономическо пространство, съгл. чл. 171а от ЗУТ. При подаване на оферта, обстоятелството се декларира от участника в ЕЕДОП и следва да съдържа информация за застрахователно покритие и валидност на съответната застраховка.
