… favour of third parties. 5.The detailed scope of the subject of the contract, the description of the requirements of the Ordering Party in terms of implementation and acceptance are determined by: Annex 5 to the ToR of Annex 1, Annex 3 to the ToR. 6.The Ordering Party shall require the submission together with the tender of the means of proof in question that the offered subject of the contract complies with the requirements of the Ordering Party set out in the description of the subject of the contract, as referred to in Annex 5 to the ToR. 7.The Contracting Authority shall provide for the possibility of supplementing the evidence in question if the Contractor has not submitted it or the evidence submitted is incomplete. The supplement shall not be applied if, despite the submission of the measure of inquiry in question, the tender is rejected or there are grounds for cancelling the procedure. The contracting authority may request contractors to clarify the content of the evidence in question. 8.The contracting authority shall not request the submission and/or supplementation if the evidence in question serves to confirm compliance with the characteristics or criteria set out in the description of the tender evaluation criteria or, despite the submission of the evidence in question, the tender is rejected or there are grounds for cancelling the procedure 9.In cases where: 1) the subject of the contract is described in the documentation of the procedure by means of standards, approvals, technical specifications and reference systems referred to in Art. 1 point 2 and paras. 3 of the Act, 2) the documentation of the proceedings refers to devices, software or systems or products with the indication of trademarks, patents, proper names, origin, source or a specific process that characterizes products or services provided by a specific manufacturer or supplier, it is assumed that such indications are accompanied by the words "or equivalent". These markings serve only to describe the minimum technical, functional and functional parameters to be met by the subject-matter of the contract. The contracting authority will consider as equivalent solutions equipment, systems and other equipment covering the subject of the contract with no worse technical, functional and functional parameters than those indicated in the CIP and other documents of the procedure. 10.The Contractor who refers to solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the devices and systems offered by him meet the requirements specified by the Ordering Party in Annex 5 to the ToR. 11. The Contractor relying on equivalent solutions shall prove to the Contracting Authority, in particular by means of the means of evidence referred to in Articles 104 to 107 of the Act, that the proposed solutions meet the requirements specified by the Contracting Authority in an equivalent manner. 12. The Ordering Party requires that the delivered equipment be brand new, i.e. manufactured not earlier than 12 months before delivery and not used for exhibition purposes and comes from a legal source.
