… of 27 February 2025, issued on the basis of Article 26a of the Waste Act of 14 December 2012, as amended by the decision of 23 December 2025, in connection with the need to remove waste posing a risk to human life or health or to the environment. The scope of the contract covers in particular the preparation of the waste for reception and transport, including, where necessary, its repackaging or pumping into appropriate packaging, securing and marking, weighing, loading, transport, transfer directly to appropriate facilities, subjecting the waste to final recovery or disposal operations and keeping the required records and documentation of waste management. In the tender form, the Contractor shall indicate one or more Target Installations intended for the execution of the contract. Each Target Installation indicated in the tender must be run by the Contractor and, in the case of contractors jointly applying for a contract, by one or more of these contractors, who will directly perform the part of the contract involving the processing of Waste. The Contracting Authority treats the final treatment of waste in the Target Installations indicated in the tender as a key task within the meaning of Article 121 of the Public Procurement Act and reserves its personal performance by the Contractor or, in the case of contractors jointly applying for a contract, by the contractor or contractors operating the Target Installations indicated. Target facilities must have up-to-date decisions, permits or permits to accept the contracted waste and subject it to appropriate final recovery or disposal operations, and have the technical and quantitative capacity to process it within the contractual deadlines. The list of Target Installations will be annexed to the agreement. The reservation concerning the Target Installations indicated in the offer does not exclude the possibility of using, in exceptional cases specified in the TIP and the draft provisions of the contract, the Replacement Installation, if there are objective technical or legal circumstances preventing or significantly threatening the proper processing of a specific waste stream in the Target Installation indicated in the offer. The use of the Replacement Installation requires the prior written approval of the Ordering Party and the fulfilment of the conditions set out in the TIP and the contract. The Substitute facility must have up-to-date decisions, permits or permits allowing it to receive certain types and quantities of waste and to undergo an appropriate final recovery or disposal operation within the contractual time limits. The Substitute installation may be operated by an entity other than the Contractor or the contractors jointly applying for the contract. Before the waste is sent to the Substitute Installation, the Contractor shall submit documents confirming its entitlement and ability to receive and treat the waste, as well as a written confirmation from the operator of the installation regarding the readiness to receive the indicated types and quantities of waste within the required time limit.
