SWZ (as regards the grounds for exclusion in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 as amended by Regulation 2025/2033 (OJ L, 2025/2033, 23.10.2025)) – the declaration must be submitted in accordance with the model set out in Annex 4 to the SWZ. These declarations constitute evidence confirming the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure, as at the date of submission of tenders, provisionally replacing the required subjective means of evidence indicated in Chapter IV, para. 2 point 2.1. Statements referred to in Chapter IV, para. 1, point 1.2. The AECEs shall submit separately: 1) The Contractor/each of the Contractors jointly applying for the contract. In such a case, the declaration shall confirm the absence of grounds for exclusion of the Contractor and compliance with the conditions for participation in the procedure, to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure; 2) the entity making resources available, the potential of which is invoked by the Contractor to confirm the fulfilment of the conditions for participation in the procedure.
