… contract shall lay down all the conditions relating to the provision of the supplies or the provision of the Services and the conditions for selecting the Contractors who will carry out the supplies or perform the Services for the Bodies from among the Contractors party to the framework contract. 4. Contracts will be executed successively, depending on the needs of the Units, after the Unit has carried out the Implementing Procedure – i.e. the Unit has submitted the Request for Contract, submitted a response to the Request for Contract by the Contractor and selected the Contractor who will perform the contract in question. 5. The list of entities which may award contracts or for which contracts may be awarded is attached as Annex 8 to the ToR. 6. In accordance with Art. 2 point 7) of the Public Procurement Act, the Contracting Authority indicates that it will conclude the Framework Contract with a maximum of three Contractors (unless fewer Contractors submit tenders that cannot be rejected), who will obtain the highest number of points in the evaluation of tenders, on the basis of the criteria set out in the tender specifications, and whose tender price does not exceed the amount allocated to finance the Framework Contract, provided that the Contracting Authority may increase this amount. In the event that the balance of points obtained is the same for several Contractors, the Contracting Authority shall conclude a Framework Contract with all Contractors. 7. The subject of the contract carried out under the Implementing Agreements concluded on the basis of the Framework Agreement consists of the following categories of Products and Services, as set out in Annex 1A to the tender specifications – Price form and in Annex 2A to the tender specifications – Overview list of products and services: 1) Subscriptions – available each time in the current price list of the Manufacturer; (2) Manufacturer's expert support services — as specified in point I.4.1. Description of the subject of the contract constituting Annex 2 to the ToR – available each time in the current Manufacturer's Price List; 3) Manufacturer's professional services – as defined in point I. 4.2. Description of the subject of the contract constituting Annex 2 to the ToR – available each time in the current Manufacturer's Price List; 4) Consultative support services of the Contractor – defined in point I. 5 of the Description of the subject of the contract constituting Annex 2 to the ToR; 8. The meaning of the terms used in the ToR is the same as the definitions used in the Model Framework Agreement (Annex 5 to the ToR) and the Model Implementing Agreement (Annex 5A to the ToR).

W celu wstępnej oceny spełniania przez Wykonawcę warunków udziału w postępowaniu oraz braku podstaw do wykluczenia, Zamawiający wymaga, aby Wykonawca złożył wraz z ofertą aktualne na dzień składania ofert oświadczenie, o którym mowa w art. 125 ust. 1 ustawy Pzp w formie standardowego jednolitego europejskiego dokumentu zamówienia (zwane dalej „JEDZ”), sporządzonego zgodnie ze wzorem standardowego formularza określonego w Rozporządzeniu Wykonawczym Komisji Europejskiej 2016/7 z dnia 5 stycznia 2016 r. ustanawiającego standardowy formularz jednolitego europejskiego dokumentu zamówienia (Dz. Urz. UE L 3/16). Wzór dokumentu stanowi Załącznik nr 3 do SWZ. 4. Zamawiający przed wyborem najkorzystniejszej oferty wezwie maksymalnie 3 Wykonawców, których oferty zostaną najwyżej ocenione do złożenia w wyznaczonym terminie aktualnych na dzień złożenia – podmiotowych środków dowodowych, potwierdzających spełnianie warunków udziału w postępowaniu: tj. Wykazu dostaw wykonanych, a w przypadku świadczeń powtarzających się lub ciągłych również wykonywanych, w okresie ostatnich 3 lat, a jeżeli okres prowadzenia działalności jest krótszy - w tym okresie, wraz z podaniem ich wartości, przedmiotu, dat wykonania i podmiotów, na rzecz których dostawy zostały wykonane lub są wykonywane wraz z załączeniem dowodów określających czy te dostawy zostały wykonane lub są wykonywane należycie. Wzór wykazu stanowi Załącznik nr 4 do SWZ (patrz Rozdz. IX pkt 3.1.1. SWZ).
