This text describes the terms of the open tender ‘Purchase of plastic teeth’, the procurement procedure and the draft contract drawn up on behalf of the Lithuanian University of Health Sciences (Lithuania). The documents regulate in detail the procedure for checking the grounds for exclusion of suppliers, the preparation and evaluation of tenders, the technical specification of the object of the contract, as well as the conditions for performance of the contract, liability and application of environmental criteria. Everything is clearly focused on the application of the Lithuanian Law on Public Procurement and EU regulations (e.g. Regulation (EU) 2022/576) from the point of view of the Lithuanian contracting authority.
First of all, the text determines what the supplier must provide and what the minimum requirements are. The tender is submitted only by electronic means via CVP IS and in Lithuanian; if necessary, duly certified translations shall be provided (except for the technical documentation in English, unless otherwise specified in the TS). The supplier must provide: a signed proposal in accordance with Annex 2, a completed technical specification (Annex 1), a completed ESPD (Annex 3), a declaration on responsible persons (Annex 5), a declaration on (non-)compliance with the EU Regulation (Annex 6), where applicable, a copy of the joint deployment agreement and a document confirming the powers of attorney of the signatory. Qualification requirements (e.g. turnover, experience, insurance) are not imposed in the evaluation of tenders (point 4.1), but the Contractor undertakes that the contract will be performed only by persons entitled to pursue the activity in question; in case of special legal requirements, they will have to justify their compliance before the start of the activity or before the signing of the contract. The grounds for exclusion are linked in detail to Sections A to D of Part III of the ESPD (criminal records, taxes, competition infringements, false information, etc.) by means of the relevant national or foreign documents required only from the successful tenderer after the ranking of tenders.

The scope of the purchase and the subject matter of the contract are described below. The subject of the procurement is ‘plastic teeth for removable dentures’, 1 garment = 28 teeth in various shapes and colours according to the VITA colour key, with at least two layers, increased hardness. Quantity provided for in the tender form – 750 sets; the total price of the offer, including VAT, may not exceed EUR 6 000.00 (point 2.4). When offering the goods, the supplier undertakes that if the product has a specified shelf life, it will be at least 1 year from the date of delivery. The draft contract provides that the initial value of the contract is equal to the price of the offer excluding VAT, the term of the contract is until full fulfilment of obligations, but no longer than 3 months from the entry into force. The goods are delivered to the place specified by the Buyer (LSMU, specified in the Special Conditions), outside peak hours and by the shortest route, and invoices and other documents are provided only by electronic means. Payment – within 30 calendar days of receipt of the invoice, no advance payment is foreseen (in the Special Conditions, this item "Not applicable").
As regards the evaluation criteria and their weightings, the documents indicate that the most economically advantageous tender is determined on the basis of one criterion, namely price. Tenders shall be evaluated on the basis of the total price of the tender in euros, including VAT, for the object of purchase; if the supplier is a foreign entity and does not report VAT, the Commission adds the amount of VAT to the comparison, ensuring an equivalent assessment. It also verifies that the price offered does not exceed the funds allocated to the purchase, that there are no arithmetic errors, and that the price is not ‘abnormally low’ (i.e. ≥30% lower than the average of unrejected tenders). With equal prices, the offer ranks higher in the queue, with the CVP IS being submitted at the earliest. Tenders shall be ranked solely on the basis of the tenders which have not been rejected and the ESPD shall require the relevant documents only from the potential successful tenderer.
Finally, risks and special conditions are widely discussed: penalties, guarantees, use of subcontractors, validity of the offer and the contract, deadlines for questions, corrections and mutual precedence of documents. Among them: the validity of the tender is not required, but the tender itself must remain valid for at least the time limit specified in point 7.13 of the tender specifications; the validity of the tender shall be recorded in the tender form or, if not indicated, it shall be deemed to be valid for as long as the documents are available. Alternatives to offers are prohibited; the supplier may submit only one tender per lot of the facility. Subcontractors (whose capacity is not based on qualification) are not required to submit an ESPD and are identified in the tender form (Annex 2) and in Part II, Section D of the ESPD; the procedure for their use and modification, as well as the requirement to inform the Buyer no later than 5 working days before the use/modification, are set out in detail in the General Terms and Conditions of the Contract (Section 3.2). The Special Conditions set a fine of EUR 200 for each case of non-compliance with environmental criteria and a fine of EUR 500 for breaches of confidentiality. Performance guarantee and advance guarantee are only applicable if provided for in the Special Terms and Conditions (this purchase is "Not applicable"), but the General Terms and Conditions describe how such guarantees would be provided and used. Questions on the tender conditions may be submitted no later than 8 days before the deadline for the submission of tenders, answers shall be published in the CVP IS no later than 6 days before the deadline for the submission of tenders, meetings of individual suppliers are not foreseen, and the site visit documents are not mentioned. With regard to possible contradictions or ambiguities in the text of the treaty, the order of validity is as follows: priority shall be given to the technical specification, then to the Specific Terms and Conditions, then to the General Terms and Conditions, then to the procurement documents and the tender; in the case of different language versions, the Lithuanian text shall be deemed authentic.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
