Provision of porter services for the Contracting Authority in the buildings of the Institute of Low Temperature and Structure Research named after Włodzimierz Trzebiatowski of the Polish Academy of Sciences in Wrocław

… Polish Academy of Sciences at: a) ul. Okólna 2 in Wrocław, on the basis of one concierge (one workstation, i.e. internal - main concierge) in a 24-hour system, b) ul. Gajowicka 95 in Wrocław, on the basis of one concierge (one workstation) from Monday to Friday from 16:00 to 8:00, Saturdays, Sundays and holidays 24 hours a day. From 8:00 to 16:00 from Monday to Friday, the services will be performed by an employee of the Institute. In the absence of an employee of the Ordering Party, the Ordering Party will commission the Contractor to perform the porter service between 8:0016:00 on working days, for additional remuneration resulting from the number of additional working hours, at the contractual rate. Employees performing porter services will be familiarized by the Ordering Party with the topography and organizational structure of the facilities. The Contracting Authority undertakes to train the staff designated by the Contractor to provide porter services in the manner in which they perform their tasks. Training of new concierge staff employed during the term of the contract will be carried out by the Contractor. A detailed description of the subject-matter of the contract is set out in Annex 1 to the ToR – Draft contract. Pursuant to Article 95(1) 1 of the Public Procurement Act, the Contracting Authority requires the Contractor to be employed on the basis of an employment relationship within the meaning of the Labour Code Act of 26 June 1974 (Journal of Laws 2025, item 277, as amended), persons performing the following activities belonging to the duties of the porter during the performance of this contract, as indicated in Chapter 3, paragraph 12.1 of the ToR. Detailed requirements for the implementation and enforcement of the requirement of employment on the basis of an employment contract are set out in the model contract constituting Annex 1 to the ToR, in accordance with Article 95(1) CTMR. 2 of the Public Procurement Act. This order is a reserved order. - Only economic operators who fulfil the conditions under Article 94(1)(b) CTMR may apply for the award of this contract. 1 point 1 of the Public Procurement Act listed below: a) have the status of a sheltered employment establishment, are a social cooperative or other economic operator whose main purpose or the main purpose of the activities of their organisationally separate entities that will perform the contract is the social and professional integration of disabled persons within the meaning of the Act of 27 August 1997 on vocational and social rehabilitation and employment of disabled persons (Journal of Laws No. Journal of Laws 1997, No 123, item 776, as amended), (b) percentage rate of employment of disabled persons within the meaning of the Act of 27 August 1997 on Vocational and Social Rehabilitation and Employment of Disabled Persons (Journal of Laws No. Journal of Laws 1997, No 123, item 776, as amended) is not less than 30% of people employed by the contractor or in its unit that will perform the contract. -In the case of joint procurement by a consortium, each member of the consortium must demonstrate that it fulfils the requirements referred to in points (a) and (b) above on its own. The Contracting Authority shall not allow reliance on the resources of a third party when demonstrating compliance with the conditions referred to in points (a) and (b) above.
