… the subject matter, scope and conditions of performance of the subject matter of the contract are set out in the Draft Contract and the Descriptions of the subject matter of the contract, which are integral annexes to the tender specifications. Main subject: 35815100-1 bulletproof vests; Additional items: 35813000-6 helmets; 38632000-4 night vision goggles; 31521320-3 flashlights on the helmet. Description of the subject-matter of the contract - Annexes 8 (concerning lot 1 of the contract), 9 (concerning lot 2 of the contract), 10 (concerning lot 3 of the contract), 11 (concerning lot 4 of the contract), 12 (concerning lot 5 of the contract), to the tender specifications - hereinafter referred to as the tender specifications. The contractor may submit a tender for one, several or all lots. Up to a maximum of 5 lots may be tendered by the Contractor. The Contractor shall deliver the subject of the contract by his own transport and bring it at his own expense and risk to the premises of the Contracting Authority, i.e. the room indicated by the Contracting Authority in the building of the Lower Silesian Voivodeship Office in Wrocław, pl. Insurgents of Warsaw 1, 50-153 Wrocław. The procedure is conducted in an open tender procedure pursuant to Article 132 of the Public Procurement Act and in accordance with the ToR. The contracting authority shall provide for the application of the procedure referred to in Article 139 of the Public Procurement Act. Contracting authority: a) does not conduct proceedings to conclude a framework contract, b) does not provide for settlement with the Contractor in foreign currencies, c) does not provide for an electronic auction, d) does not provide for the submission of a tender in the form of electronic catalogues, e) does not provide for the granting of advance payments for the performance of the contract, f) does not allow for the possibility of submitting variant offers, g) does not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Public Procurement Act, h) due to the subject matter of the contract, does not impose requirements related to the performance of the contract referred to in Article 95 of the Public Procurement Act, and) does not provide for requirements regarding the employment of the persons referred to in Article 96(1) of the Public Procurement Act. 2 point 2 of the Public Procurement Act, j) does not provide for an on-site inspection at the place of delivery of the subject-matter of the contract, k) pursuant to Article 138 par. 2 point 2 of the Public Procurement Act, the Contracting Authority shortens the deadline for submitting tenders, but not less than 15 days from the date of submission of the contract notice to the Publications Office of the European Union. The Ordering Party is obliged to provide explanations immediately, but not later than 4 days before the deadline for submission of tenders in the case referred to in Art. 2 point 2 (in the case of a shortened deadline for the submission of tenders) ,, provided that the request for clarification of the content of the tender specification was received by the contracting authority no later than 7 days before the deadline for the submission of tenders. The draft provisions of the public procurement contract to be incorporated into the content of the contract are attached as Annexes 2, 2a, 2b, 2c and 2d to the ToR.
