… the subject-matter of the contract: 1) The Contractor is obliged to perform the subject of the contract with due diligence and in a timely manner. 2) delivery along with bringing the subject of the order, assembly, installation and commissioning will be carried out by the Contractor's own transport to the premises of the Hospital. The Contractor is obliged to properly secure the goods for the duration of the transport. The subject of the order will be delivered by the Contractor with his own efforts, at his expense and risk. 3) The Ordering Party shall require the Contractor to guarantee that the delivered medical equipment (including equipment) is brand new, has not been used, the date of production complies with the requirements set out in the Terms of Reference, non-exhibition, non-remanufactured, complete and ready for use without any additional purchases besides consumables, and that there are no physical and legal defects. 4) The Contractor undertakes to supply the delivered equipment and equipment with appropriately visible, legible and indelible markings, i.e.: each device shall be accompanied by the information necessary for its safe use and to identify the manufacturer. 5) adapting the connection of the subject of the contract to the utilities (to the existing infrastructure) in the Hospital – if connection to utilities is required for a given subject of the contract – on the side of the Contractor. 6) The Ordering Party requires that the offered subject of the contract meets the requirements set out in the applicable law, has been released for free circulation and has the documents required by law, confirming approval for use in Poland. 3. GUARANTEE: 1) The duration of the guarantee (in relation to each of the Packages) is one of the criteria for the evaluation of offers specified in point. XIX SWZ. 2) For all lots (3 packages), the minimum warranty period is 24 months and the maximum is 60 months. The warranty period starts from the date of signing the final acceptance protocol of the subject of the Agreement. 3) The Contractor is obliged to indicate the duration of the guarantee, for the Package offered by him, in the Offer Form (according to Annex No. 1 to the Terms of Reference). 4) Detailed terms and conditions of guarantee and warranty are specified in the draft provisions of the contract, constituting Annex 4 to the Terms and Conditions. 4. Equivalence: In view of all the standards indicated and required in the Terms of Reference, European technical assessments, approvals, technical specifications and reference systems and certificates, the Contracting Authority accepts equivalent solutions. The names given by the Ordering Party, trademarks are of an exemplary nature, and their indication is aimed at determining the expected standard. The contracting authority shall allow equivalent tenders to be submitted. As an ‘equivalent product’, the Contracting Authority will consider a product with no worse technical parameters than those indicated in the description of the subject-matter of the contract.
