The procurer shall require that the supply offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, whether as main components or as components, elements of the service environment or accompanying solutions, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of state security; (2) an ICT product, the type of which has been specified in the decision on the recognition of the provider as a high-risk provider referred to in Article 67b(2) of Regulation (EC) No 44/2001; 15 of the Act of 5 July 2018 on the national cybersecurity system, nor ICT services or ICT processes specified in this decision. Failure to comply with the above requirement results in the rejection of the offer pursuant to Art. 1 point 17 or point 19 of the Act.
